Cowardly Prosecutor, Boulder, Jonbenet Ramsey

Cowardly prosecutors are notorious for making deals, or picking on some easy cases.

Alex Hunter had an insane plea making record.  The thought of going up against someone in the private sector scared him into making agreements.

The best and brightest are drawn into private practice, where the money is.  What is left is excuse making.

When someone says, "This case can't be prosecuted.  I have 25 years experience prosecuting!" what they are saying is, "I can't prosecute this case. I'll lose!  Let's not talk about the evidence.  For 20 years, I have been by passed by the private sector and will get eaten alive by private attorneys!"

In 1999, the Boulder Grand Jury found that John and Patsy Ramsey caused the death of their daughter via child abuse.

Alex Hunter, fearing the Ramsey team attorneys, refused to sign the indictment!


A press advocacy group and a Boulder Daily Camera reporter are suing Boulder County District Attorney Stan Garnett seeking the release of an indictment that was secretly voted on by the JonBenet Ramsey grand jury in 1999 but never prosecuted.
Reporter Charlie Brennan and the Reporters Committee for Freedom of the Press filed the lawsuit in Boulder District Court on Wednesday, citing the Colorado Criminal Justice Records Act in an effort to compel Garnett to release the indictment.
The newspaper is not participating in the lawsuit.
Six-year-old JonBenet was found dead Dec. 26, 1996, in the basement of her family's home, hours after her mother told police her daughter was missing. Her killer hasn't been identified.

A coward even before the Casey Anthony case changed US prosecution of these cases, or the lack there of. That may not be the case, but it sure seems to be.

And then there was the prosecutor in the Jerry Sandusky child abuse case who refused to prosecute Jerry way back in about 1998? If only he had, many additional boys would have been spared further abuse, as well as those Sandusky was already abusing!

NOW this errant prosecutor has been missing for several years, along with his destroyed computers and all the prior evidence, leaving no explanation as to WHY he refused to prosecute Sandusky.

Evidence found in and taken from the house, according to the warrant, includes red stains on walls and floor boards, swabs taken of those stains now being tested for blood, two knives and show a fascination with JonBenet Ramsey, the Colorado girl who was murdered in her own home and whose killer has never been caught..... Whose faked abduction/staged murder inspires evilness. Poor Erica!

These Prosecutors who refuse to take on a case because they say there is not enough evidence is a load of BS.

Its all about saving face than getting to the Truth..

True John. That, and these prosecutors having 'all power' to be able to make-or-break these decisions that allow criminals to walk free without prosecution. They are taking it upon themselves to make a one-man decision; "no, you can't do it because I SAID SO". This is wrong.

Why have a grand jury at all if it's up to the prosecutor in the end anyway? Whose to say there isn't hanky panky involved with the prosecutor in some of these cases when it's all up to ONE man as to whether an individual gets prosecuted? As an example, who can say the prosecutor in the Sandusky case wasn't paid off or had his life threatened if he prosecuted Jerry Sandusky? How easy it is to corrupt just ONE person who has the final authority!

While I don't believe that all grand juries make the right decisions, as they too are made up of common folk who have little to no knowledge of the laws governing any case, and are listening to a lot of speculation themselves, as well as some evidence; nonetheless, they are the people and the people have spoken in the voice of the grand jury.

If the grand jury comes back with an indictment for prosecution, then IMO, the prosecutor should be legally bound to prosecute that person (or persons) and should not have the sole power to make these fatal and final decisions as to guilt or innocence.

While I have never believed the Ramseys killed JonBenet, (primarily because none of the so-called evidence against them made any sense whatsoever); that doesn't mean they didn't do it, and it is irrelevant what I or anyone else thinks. IF the grand jury handed down an indictment for their prosecution, then they should have been prosecuted and let the facts or fiction fall wherever it may; the final decision should NOT have been the prosecutors' decision to make.

I can't blame Alex Hunter for fearing the Ramsey team of lawyers.

There was so much contamination of the crime scene that the Ramsey lawyers would tear apart the police detectives and embarrass them.

Everyone connected to the investigation would have been excoriated in a public forum, while the Ramsey lawyers conducted a witch hunt without fear of consequences.

The Ramsey family and the death of JonBenet would have been put aside while their lawyers sifted the Boulder Police Dept. and exposed their chaff in an effort to make them go away and shut this case down.

Money buys freedom in America.

To add to my Ot above..I just read it again and notice i only highlighted.

As we know anything said in the negative is sensitive.I should of also highlighted "WE'RE".Why does she(Their Attorney) feel the need to share this part of her statement.If she had confidence in their innocence would she not say"I am not concerned",although again it is said in the negative, she would be taking ownership of her word's,thus believing their account of what happened.

Every time I read about this awful case, I just get so frustrated inside. If all the family members knew Erica was being abused, why didn't they do something, anything?

The family members that saw abuse and didn't report it should be charged with something. The abuse (remember it sounds like Erica had a learning disability)was profound and not something they just wondered about or couldn't pin down.

This just keeps standing out to me, that the family doesn't even think it is odd that they (the family)didn't step forward.

The sheer audacity of Erica's adoptive parents behavior is unbelievable.

The body of missing baby boy has been discovered in a container in an upstate New York river.

Authorities confirmed on Saturday that remains found near Utica earlier this month belonged to 10-month-old Levon Wameling.

In June, Levon's father, Jevon Wameling, told his parents, who then told police, the child was taken from his porch two weeks earlier but he failed to report his son missing at the time.

State police divers found the child's body in the Mohawk River on September 6, after a tip off.

Following extensive DNA testing, the Onondaga County medical examiner's office in Syracuse verified the baby was Levon, police said on Saturday.

The medical examiner, however, hasn't provided a cause of death, CNN reported.

Sergeant Steve Hauck said the police were determined to get to the bottom of the baby's death.

'The Utica Police continue to investigate this case, with the hope that the truth will be learned and the person(s) responsible are held accountable,' Hauck said in a statement.

Last month, Wameling was arrested on suspicion of breaking into a home in a suburb of Utica to steal jewelry and money.

Hauck hasn't said whether the father had anything to do with the tip leading police to the remains. He did however say police had questions about the man's involvement from the start.

In June, Levon's mother, Amy Warney, pleaded for help finding her son, who was last seen May 29 by his father.

Wameling, 27, waited nearly two weeks to report his son missing, according to the The Utica Observer-Dispatch.

'I would like to ask anybody that's out there if you know where he is, or if he's alive or dead, just please call the Utica police Station so I can just put him to rest,' Warney said through tears at a June news conference.

'Just please, don't be scared. Just if you know anything, just please contact somebody.'

Levon's grandparents reported him missing to the Oneida County District Attorney Scott McNamara, who immediately notified police, according to WKTV.

After his son was reported missing, Wameling told police Levon disappeared two weeks earlier when Wameling left the baby unattended on the front porch wearing nothing but a diaper. Wameling said he left the baby alone while he was trying to get back into his home after locking himself out.

Police said Wameling came forward only after Levon's mother asked where her child was.

'Here's the thing, we have a problem with what he says,' Utica Chief Mark Williams said at the time.

'Here’s a guy that waited two weeks to come forward. He doesn't bring it forward to the police, but brings it forward to his parents. Instead he goes to an attorney's office. I think actions speak louder than words.'

A large scale search ensued for the boy with a state police helicopter hovering over the neighborhood where Levon was last seen and K-9 units continued to hunting for him on the ground.

In addition to state and local authorities, the FBI, the National Center for Missing & Exploited Children, the U.S. Marshals Service and the Oneida County District Attorney's Office assisted in the search effort.

Williams told CNN that the father's delay is only making it harder for them to find the child.

'When you have a missing child, there's all these difficult cases,' he said. 'But when you're two weeks behind, it's nearly impossible.'

Despite the father's 'suspicious' behavior, authorities' focus has been to find Levon.

'We obviously have very grave concerns about the child. First and foremost, is where this child?' Hauck told YNN at the time. 'We need to know what happened. Wherever the evidence leads us is where we're going to go. If we find a crime was committed, then we're going to take appropriate steps to bring that person to justice. But right now, our biggest concern is finding this child.'

Though he is not a suspect, police said they are are treating Wameling as a 'person of interest'.
Levon was staying with his father while Warney was at a drug rehabilitation facility, police said.

'As far as she knew, the child was being cared for by Jevon and was doing fine,' Hauck told The Observer-Dispatch.

Levon's father has a criminal history.

Wameling was charged with resisting arrest, escaping police custody and harassment in May 2010 after being arrested for allegedly possessing metal knuckles, according to WKTV.

In 2009, he was convicted of marijuana possession. Neighbors told the station the cops were called to Wameling's home on a 'weekly basis' because of screaming.

Hi Hobnob-

It's confusing the way the article is written but that quote is from Amy Warney, the babies mother. I'm not sure if the father has spoken publicly because he had a lawyer before the crime was even reported!

Warney spoke out and asked for Levon's return (at the time he had already been missing 2wks+), after she left rehab. I still found it strange that she was ready to accept that her baby was dead, but in reality Levon obviously couldn't survive for 2wks without care. Such a sad case, and the 'father' actions speak volumes. I hope he is prosecuted and this case doesn't turn into another Ayla or Hailey case, where the crime and the culprit go unpunished.

With the Levon Warney case, who tipped off police to the whereabouts of the baby, because I would say THAT'S WHO DID IT! The Dad definitely did something real bad, like maybe sold the baby for drugs or something. But who else would be able to drop a tip telling where the baby's remains besides the perp. If the Dad tipped off the cops, he'd be in jail--yeah I think that would be enough evidence to get him.

To be fair, I think Alex Hunter probably WAS an inept prosecutor. And since murder has no statute of limitations, it may be for the best that he declined to prosecute the case against any family member of a CEO of a billion dollar corporation. With a prosecutor who knows what they're doing, there's at least a small chance of actually being successful prosecuting the case some day. Unless the suspect was Patsy, in which case it's too late.

Isn't it the truth! Casey Anthony taught 'parents' like these (Wameling, Dip, Irwin, etc), the formula for getting away with murder. Hide the body so it won't be found until decomp destroys all the evidence, delay reporting as long as possible, and when the time comes..spead their kidnapping propaganda far and wide.

If the Dad is the one who tipped off police and the Dad is not being charged with murder, I'd say that's some pretty crappy police work. It seems someone had to have tipped off cops to search a specific part of the river, kinda strange cops are not saying who tipped them off, since this has to be the perp. To me, something sounds shady. I'm not taking this story on face value, this little twist of "an unnamed person who knew the location of the baby in the river" makes it a lot different than the Casey Anthony case. Sometimes serial killers will do this kind of thing with tipping off police. Who tipped the cops off since it wasn't the Dad (because they'd be charging him with murder!!)
