Analytical Interviewing Exercise

       

                Analytical Interviewing

Simply put, Analytical Interviewing is the seeking of information, via the interview, based upon Statement Analysis.

This means we often seek a written statement prior to the interview.

We ask legally sound, open ended questions.

We then ask follow up questions based upon the subject's own language, seeking to, whenever possible, avoid introducing language to the subject.

We then ask questions based upon the analysis of the written statement, and questions based upon other evidence.

Note the statement which follows.   Your assignment is to put together at least eleven (11) questions for the interview.

We will do analysis of the statement later.


One night I had a visitor.
It was a friend or rather a relative.
He was from out of town.
And he came up for the weekend.
I invited him into my apartment and gave him a mixed drink.
Later on he went back to his car and brought out beer he had
been drinking.
He also had a gun that he brought into the apartment.
He proceeded to get very drunk.
I eventually went to sleep.
When I woke up he was very drunk and there was beer cans
and beer bottles strewn all over my apartment.
He was smoking a cigarette and using an ashtray that was full of
paper.
There was also cigarette butts in my carpeting.
I started raising hell and at one time I thought he was going to get
violent.
He started shaking me and wouldn't let me move.
All I could think about was the gun he had brought in.
I thought I was going to have to call the police to get rid of him.
Finally I just made him drink the end of the beer and I stayed up
until he went to sleep.
That's it.

You do not know what the allegation is, therefore, you do not know why the subject is writing.  In Analytical Interviewing, like Statement Analysis, we do want to know the allegation, that is, the reason why the subject wrote.  We do not wish to know anything other than the allegation, so that our analysis is not influenced by external sources.  This is often impossible when a case is well known.

Look at the same statement again, with emphasis added.

Your exercise here is to formulate questions based upon your analysis.  Leave the questions, numbered, in the comments section.  Include the portion of the statement (copy/paste) that your question is based upon.  Allow the underlining of words guide your questions.  Dispense of the introductory questions, rapport building, and so on, and move right to analytical questions.

You are to write at least one question for each underlined word.  See if you can identify the element of Statement Analysis

What gappened after you invited him in and gave him a mixed drink?

what went on between you before you eventually went to sleep?

What happened in the apartment with the gun that it went from my apartment to THE apartment and back to my apartment?

You started raising hell you don't say you completed raising hell, what is your definition of raising hell?

What caused you to think he was going to get violent, not that he was actually being violent

What caused him to start shaking you and prevented you from moving?

if the situation was as bad as claimed why did you not call the police, a drunk and a gun is just asking for trouble?

what happened between you thinking you might have to call the police and making him drink the beer?

What did you do after he went to sleep?


I picked up on the distancing in the relationship. he wasn't a friend he was a relative. What are the dynamics between these two people?

Hobnob, I got the impression it was an old friend with benefits or a past relationship of some sort.

1. Your apartment? (I would let the subject decide what I mean by this question and let him volunteer his own clarification. For example, he may clarify that he is on the lease but his girlfriend lives with him.)

2. What happened between his arrival and his return to his car?

3. The apartment? (I have the same agenda as in Question 1.)

4. What happened between his return to the apartment and you falling asleep?

5. Nice apartment? (I'm hoping for out-of-bounds responses.)

7. What did he do?

Off Topic: I am watching Fox news right now, and they just interviewed Abigail Hernandez' mother. Wow, all I can say is they need to be taking a REAL close look at this lady.
Abby has supposedly sent the mother a letter (mother did not reveal anything
in it).
THIS WOMAN IS LYING.
It sounds like she wrote herself the letter.
It's strange because after reading the father's statement, I thought he was setting the scene for a fake communication from Abby.
Mother has a PO Box out of town , finds letter from Abby.
Interviewer asked her "Did you recognize her handwriting right away?"
She can't answer question.
I wonder if the Mom did something to her, or is this the Dad sending fake communication to the mother? Either way, you could tell she was lying.

Some really good questions being posted. Also though, lots of compound questions being asked, which isn't good practice when interviewing.

You always manage to drive away your good (more intelligent) posters, don't you Peter? You just can't stand it when someone comes along who might be a little brighter than you are. Dumbass, always clamoring for the spotlight, so afraid someone else might receive a little acclaim.

One thing is certain: you are NOT a savvy businessman. Just how the hell do you expect to keep enough good posters around that might click on your advertisers links when you become so spiteful and jealous of other posters that you drive them away?

This account seems out of order and missing time. I'd try to get those spaces filled in with my questions.

1. Did you know he was coming to visit when you invited him in?

2. Did you two leave your apartment that night? (The writer said "back to the car" and "beer he was drinking"...when?)

3. How did you know he had a gun?

4. Was he drunk before you fell asleep? How could you tell?

5. Describe how you felt when you saw beer bottles and cans, and butts on your apartment floor.

6. You say you STARTED to raise hell. How did you do that?

7. What does he do when he is "going to get violent"?

8. Explain the interaction between you two when he shook you.

8b. Where was the gun as he shook you?

9. Did you threaten to call the police or ask him to leave?

10. Tell where each of you were in the apartment while he drank the end of the beer and you stayed up.

Prosecutors have charged a former University of Missouri Kansas City student with cyber stalking a university instructor.
Court documents allege Kenna Haight, 27, sent over 100 threatening emails to the instructor who has remained unidentified. Haight’s emails at times said she wanted to killed and sexually assault the female instructor. Haight started sending the emails in September 2012.
According to court documents Haight began sending the because she was upset the instructor changed a class syllabus, saying the change caused her to be sexually assaulted.
In one of the emails, Haight wrote in part, “Sleep with one eye open, if I decide I need revenge just in case I change my mind you will be dead on the 1st anniversary of the day I was raped because of you.”
In other emails Haight lashed out using graphic details of what she would like to have done to the instructor.
“If I had known I would have killed you while I was your student and I had means, motive and opportunity!” she wrote.
In another email, she said, “If I had a penis I would put a gun to your head and rape you and make you fear for your life.”
The University of Missouri Kansas City has declined comment.
Haight is in federal custody in Suffolk, Va., where she was arrested and is being held without bond.
