I learned on here that when somebody "knows" the victim is dead before the paramedics pronounce them dead then they wanted them dead - and killed them.

but the passivity at the top should be enough to convict -- sat there for who knows how long and cried - instead of callimg paramedics. it shouldn't matter if he though she was an intruder -- that choice along should be willful neglect resulting in murder.

A lot of things don't make sense (of course). He couldn't support her weight, yet he did carry her downstairs. Why did he call someone else first, before calling 911? I don't understand why 911 would tell him to get her to a hospital, wouldn't the ambulance (maybe I'm misunderstanding him)? Maybe a stupid question, but why was her arm broken? Is that common from a gunshot wound?

With the information I saw on here yesterday about the bedroom door and blood in the bedroom, it would seem that the altercation began outside of the bedroom, she locked herself in the bedroom, he got in, so she locked herself in the bathroom. I also saw on here yesterday that he claimed to have heard the window in the bathroom. I wonder if that was true, and she was trying to escape him.

There is a lot of "I sat" with body posture being an indication of tension in the telling of the story. "I knelt down next to Reeva, her weight was on the toilet bowl.","I sat there, I don't know for how long and cried", "I sat on the floor in the kitchen crying", "He addressed me, but I was unable to speak to him. I just sat there crying.", "At times I couldn't stand, I would just sit there.", "I sat in the kitchen and also in the pantry."

He also accepted her death quickly, "sitting" and crying for a long time after seeing her, and stating that he knew she had died before the paramedics arrived. He did not try to save her. Innocent people are irrational in their desire to save their loved one, even if wounds are terrible and others can see the person is dead.

When asked if there was anyone else in the house, he "mentioned" that there was not. Strange choice of words. He didn't tell them there wasn't, just mentioned it?

Missy, I agree, he accepted her death very quickly. If I'm reading his statements correctly, he's saying she was still alive when he got in the bathroom. Yet he didn't call 911? Try to save her? Just cried? Oh, he did kneel down beside her with his fingers in her mouth...

i like the fact that he said he would try not to lie.

Talk about leaking marbles and broadcasting his intent to the world :)

Hobnob: Do you remember where he said that? I can't find it...

Roux: OP I asked Mr. Mongena to bring the cricket bat today.
by Sky News court reporter 9:04 AM

Roux: Whilst he is fetching the bat, please can you demonstrate without hitting the door, how you tried to open the door.
by Sky News court reporter 9:05 AM

Roux: I do see that there was a call to Mr. Divaris, please can you explain that?
by Sky News court reporter 9:05 AM

OP: I know Miss Stander asked if there is anyone I wanted to call. I phoned Mr. Divaris, I can't remember actually speaking to him.
by Sky News court reporter 9:05 AM

OP: I also phoned my agent as we were very close friends.
by Sky News court reporter 9:06 AM

Roux: Did you ever phone a lawyer?
by Sky News court reporter 9:06 AM

OP: No, my lady.
by Sky News court reporter 9:06 AM

Roux: According to the evidence by the state, you were on your stumps when hitting the door with the cricket bat.
by Sky News court reporter 9:06 AM

OP: I can barely stand on my stumps, yet use a cricket bat.
by Sky News court reporter 9:06 AM

Roux: With regards to the evidence, neighbours hear sounds. At about 3:19 you made a call to Mr. Stander. Do you have any idea what those 3 sounds represent?
by Sky News court reporter 9:07 AM

OP: It would have been the 3 times I hit the door with the cricket bat.
by Sky News court reporter 9:07 AM

Roux: Were you walking in the bathroom shortly before hitting the cricket bat?
by Sky News court reporter 9:08 AM

OP: Yes, I was walking to go fetch the cricket bat with my legs on.
by Sky News court reporter 9:08 AM

Roux: If you can draw a timeline, I know it is difficult. Now referring to 3:12, he woke up. How long after you fired the shots did you hit the cricket bat?
by Sky News court reporter 9:09 AM

OP: I don't know my lady. About 5 minutes.
by Sky News court reporter 9:10 AM

Roux: More or less be consistant with Mr Johnsons' notes?
by Sky News court reporter 9:10 AM

OP: It would be consistant.
by Sky News court reporter 9:10 AM

Roux: What do you say about Dr. Stipps' evidence, think away Miss. Burgers' evidence. Think away the notes of Mr. Johnsons' notes. What do you say about Dr. Stipps' notes?
by Sky News court reporter 9:11 AM

OP: It physically can't be, if you look at the time of the calls. Out of many, many facts the sounds.
by Sky News court reporter 9:12 AM

Roux: I want you to give evidence about you kicking the door. If you would not mind go to the door and show how how you can kick the door.
by Sky News court reporter 9:12 AM

Roux: Just point to where you made contact.
by Sky News court reporter 9:13 AM

Roux: It seems to me, it is just above the door handle.
by Sky News court reporter 9:13 AM

Judge: Mr. Nel?
by Sky News court reporter 9:13 AM

Nel: It is, my lady.
by Sky News court reporter 9:13 AM

Roux: Demonstrate tot he court how you would have handled the cricket bat. Without hitting the door.
by Sky News court reporter 9:13 AM

OP: I watched the demonstration that has been done on the door. To say it is untrue, I disagree. I used my entire body, it is very difficult to show you know in a passive way.
by Sky News court reporter 9:14 AM

Tania Cadogan said...

OP: But I will do so.
by Sky News court reporter 9:14 AM

Roux: Could you tell the court what you demonstrated?
by Sky News court reporter 9:14 AM

OP: My lady, I was demonstrating how I hit the door. It was more or less, if you stand further from the door, you will hit the door lower. I hit the door with all my might.
by Sky News court reporter 9:15 AM

OP: I doubt I remained in the same position. I had socks on my prosthetic legs, I was standing on tiles. I doubt I was standing in the same position the whole time.
by Sky News court reporter 9:16 AM

Roux: I then want to take you to photo 120. OP, we are going to deal with the state witnesses not dealt with by the state.
by Sky News court reporter 9:16 AM

Roux: Would you identify the circle on the photo of the arrow. It is in fact your house?
by Sky News court reporter 9:17 AM

OP: That is correct, my lady.
by Sky News court reporter 9:17 AM

Roux: Then the house next to your house is the neighbour.
by Sky News court reporter 9:17 AM

OP: That is correct, my lady. I know him as Kenny.
by Sky News court reporter 9:18 AM

Roux: He also makes note to his statement that he heard crying and not screaming. Please can you explain to the court your relationship with this person.
by Sky News court reporter 9:18 AM

OP: We moved in around about the same time. I gave him trees as a welcoming gift.
by Sky News court reporter 9:19 AM

Roux: Apart from that, have you every had any other contact with him?
by Sky News court reporter 9:19 AM

OP: I have seen his kids playing in the street, I greet him when I see him.
by Sky News court reporter 9:19 AM

Roux: Have you ever been to his out apart form the gift you gave him?
by Sky News court reporter 9:19 AM

OP: I never went into his house
by Sky News court reporter 9:20 AM

Roux: Did he ever go into your house? Did you know his wife?
by Sky News court reporter 9:20 AM

OP: He never came into my house and I never knew his wife.
by Sky News court reporter 9:20 AM

Roux: Okay, now if we look at the neighbour on the other side of your house.
by Sky News court reporter 9:20 AM

Roux: Did you know him?
by Sky News court reporter 9:20 AM

OP: Yes, we had the same building contractor. He had been inside my house to look at the workmanship of the builder.
by Sky News court reporter 9:21 AM

OP: When he moved in, we realised that we both had a passion for motorcycles. We would greet each other if we saw it each other.
by Sky News court reporter 9:22 AM

Roux: Have you every been to his house for a social event?
by Sky News court reporter 9:22 AM

OP: I have been into his house but never for a social event.
by Sky News court reporter 9:22 AM

Roux: Could you demonstrate on the photo where your bathroom window is to his bedroom window.
by Sky News court reporter 9:23 AM

Roux: Are they on the same side?
by Sky News court reporter 9:23 AM

OP: They are on the same side.
by Sky News court reporter 9:23 AM

Roux: Do you know his wife?
by Sky News court reporter 9:23 AM

OP: I have met his wife, they got married a couple of years ago. I met her on a brief interaction between myself and him.
by Sky News court reporter 9:23 AM

OP: I know them as Mike, my neighbour.
by Sky News court reporter 9:24 AM

Tania Cadogan said...

Roux: We know from there statements, that she woke up for a noise. She heard loud crying and not a woman screaming.
by Sky News court reporter 9:24 AM

Roux: Do you know the lady that works for Dr and Mrs. Stipp?
by Sky News court reporter 9:25 AM

OP: No, my lady.
by Sky News court reporter 9:25 AM

Roux: She, is her statement is to be believed heard loud crying and not a woman screaming.
by Sky News court reporter 9:25 AM

OP: Yes, my lady. I heard that is what she heard.
by Sky News court reporter 9:25 AM

Roux: The noises relied upon form the state, Mrs, Stipp heard noises. Her husband told her that he saw a man walking in the bathroom. Relevantly shortly before 03:17.
by Sky News court reporter 9:26 AM

OP: That is correct.
by Sky News court reporter 9:26 AM

Roux: Now, if you were walking in the bathroom with your legs on, would you cover the bathroom window?
by Sky News court reporter 9:26 AM

Judge: I don't understand.
by Sky News court reporter 9:27 AM

Roux: To what extent would your body cover the window?
by Sky News court reporter 9:27 AM

OP: My lady, if I don't have my prosthetic legs on, only my head would stick out over the window. In Mr. Stipps' evidence, he saw a person with a light complexion move from right to left.
by Sky News court reporter 9:28 AM

OP: He would not have been able to see me, if I did not have my legs on.
by Sky News court reporter 9:28 AM

Roux: Let's accept this, what were you doing in the bathroom?
by Sky News court reporter 9:28 AM

OP: They must have seen me running form right to left to kick the door, my lady.
by Sky News court reporter 9:29 AM

Roux: I know it is a stupid question, did you take your legs off after hitting the door with the cricket bat and then fired the shots?
by Sky News court reporter 9:29 AM

OP: No, my lady. The only way they could have seen me was when I had my legs on trying to kick the door open and then getting the cricket bat.
by Sky News court reporter 9:30 AM

Roux: OP did you intend on killing Reeva?
by Sky News court reporter 9:30 AM

OP: No, my lady, I never intended on killing Reeva or any-body else.
by Sky News court reporter 9:30 AM

Roux: My lady, can we adjourn for a few minutes to let Mr. Olodwage get ready.
by Sky News court reporter 9:31 AM

Judge: Yes.
by Sky News court reporter 9:31 AM

Roux: Thank-you my lady. We have nothing further.
by Sky News court reporter 9:37 AM

Nel: You were a model sports man?
by Sky News court reporter 9:38 AM

OP: Yes, my lady.
by Sky News court reporter 9:38 AM

OP: I made a mistake
by Sky News court reporter 9:38 AM

Nel: You killed her. You shot and killed her.
by Sky News court reporter 9:38 AM

OP: I did my lady.
by Sky News court reporter 9:38 AM

Nel: So say it, you shot and killer her.
by Sky News court reporter 9:38 AM

OP: I did, my lady.
by Sky News court reporter 9:39 AM

Nel: People look up at you as a sport hero.
by Sky News court reporter 9:39 AM

Tania Cadogan said...

OP: I don't look at my media any more, I know before there was some people that looked up at me.
by Sky News court reporter 9:39 AM

Nel: Let's look at the truth.
by Sky News court reporter 9:40 AM

OP: I am here to tell the truth for me and Reeva.
by Sky News court reporter 9:40 AM

Nel: You are not hiding anything.
by Sky News court reporter 9:40 AM

OP: No, my lady.
by Sky News court reporter 9:40 AM

Nel: You live like a christian?
by Sky News court reporter 9:40 AM

OP: I try do, my lady. I have made mistakes.
by Sky News court reporter 9:40 AM

Nel: So as a Christian, you will tell the truth.
by Sky News court reporter 9:40 AM

Nel: What is a Zombie Stopper?
by Sky News court reporter 9:41 AM

OP: I don't know my lady.
by Sky News court reporter 9:41 AM

Nel: Have you ever been in the presence of a person using or talking about a Zombie stopper?
by Sky News court reporter 9:41 AM

OP: I do not know of anything.
by Sky News court reporter 9:41 AM

Nel: Would you be surprised if you see footage of yourself with someone else using the word as a zombie stopper?
by Sky News court reporter 9:42 AM

OP: Yes, my lady.
by Sky News court reporter 9:42 AM

Nel: So, if I show you footage from Skynews of you in footage of someone using the word zombie footage. You still do not know of anything?
by Sky News court reporter 9:42 AM

OP: I do no, my lady.
by Sky News court reporter 9:42 AM

Roux: My lady, I object.
by Sky News court reporter 9:43 AM

Nel: It is in the public, it is on Skynews. I asked the witness, would you like to see it, he said yes.
by Sky News court reporter 9:43 AM

Nel: It is part of my cross-examination. If the defence would like to stand down and view it, I have no problem.
by Sky News court reporter 9:44 AM

Roux: My lady, there is confusion. In Section 197, it states this. You have a choice as the prosecuter to view what you see fit.
by Sky News court reporter 9:44 AM

Roux: You cannot in ambush, present evidence.
by Sky News court reporter 9:45 AM

Nel: My lady, I asked a question. From that question, the witness said he wanted to see it. Surely I can ask questions about if he shot at a Watermelon.
by Sky News court reporter 9:46 AM

Nel: So my lady, if it goes towards his character. If the witness wants to see it then he can.
by Sky News court reporter 9:47 AM

Judge: What is the difference in showing him and asking questions. What is the difference from asking questions?
by Sky News court reporter 9:47 AM

Roux: My lady, he can ask questions, but you may not introduce new real evidence.
by Sky News court reporter 9:48 AM

Judge: What if the video supports the questions.
by Sky News court reporter 9:48 AM

Roux: My lady, it will always goes with the questions. You can ask as many questions as you want to but to bring in new evidence that is not forming part of the case.
by Sky News court reporter 9:49 AM

Roux: You have to do that in the states case, you cannot bring in new evidence in the cross-examination. It was not part of the docket, it is new.

by Sky News court reporter 9:49 AM

Nel: My lady, I am re-itterating my arguement again. I asked the witness if he wants to see. I think it is fair to every one that he sees it.
by Sky News court reporter 9:50 AM

Nel: I can't ask him questions, if he hasn't seen it. I am not entering it as evidence, I'm showing it to the witness.
by Sky News court reporter 9:50 AM

Nel: We both agree, Mr. Roux and myself agree that we can deal with character evidence. Then on basis, I asked the witness if he wanted to see it, and he answered yes, he wants to see.
by Sky News court reporter 9:51 AM

Judge: We will take a few minutes. There is something that I want to check first.
by Sky News court reporter 9:51 AM

Court adjourned.
by Sky News court reporter 9:51 AM

Court is in session.
by Sky News court reporter 10:16 AM

Judge: I have had time to consider the submissions by counsel. So what I am going stand this down, so to allow time for the defence counsel to have time to look at it.
by Sky News court reporter 10:17 AM

Court is adjourned.
by Sky News court reporter 10:17 AM

Court is in session.
by Sky News court reporter 10:56 AM

Roux: My lady, I will make a submission to you that I believe will resolve your findings in this matter.
by Sky News court reporter 10:57 AM

Roux: 25 September 2013, a letter written, requesting information from the state. Stating that we will not allow any evidence to be brought into the trial if it was not presented to our client beforehand.
by Sky News court reporter 10:58 AM

Roux: However, we have done so my lady. He has not seen the video clip, we have seen it. We are not persisting, with the understanding that it will not be put as evidence.
by Sky News court reporter 10:59 AM

Roux: But as cross-examination. Taking everything into consideration, we will not be against it.
by Sky News court reporter 10:59 AM

Nel: As the court please. I agree with this submission. May I request that we view the video?
by Sky News court reporter 11:00 AM

Judge: Yes, you may.
by Sky News court reporter 11:00 AM

Court watches the video clip.
by Sky News court reporter 11:00 AM

Nel: Thank-you my lady. That is how far we will view.
by Sky News court reporter 11:00 AM

Nel: can you know recall this video?
by Sky News court reporter 11:01 AM

OP: I can recall, I have seen this video before. I do not remember using the word zombie-stopper. It wasn't be laughing in the background, but it is me suing those words.
by Sky News court reporter 11:01 AM

OP: Having heard it now I am quite saddened that I used those words.
by Sky News court reporter 11:02 AM

OP: I wouldn't never really use those words in comparision to a human.
by Sky News court reporter 11:02 AM

Nel: But you did, you said "brains"
by Sky News court reporter 11:02 AM

Nel: What ammunition did you use there?
by Sky News court reporter 11:02 AM

OP: A firearm that was made for trail walking overseas. It didn;t use Black Talon ammunition but a much bigger ammunition.
by Sky News court reporter 11:03 AM

Nel: The bullet had the same effect on Reeva's head. ou saw how the bullet made the watermelon explode. You know that the same thing happened to Reeva's head.
by Sky News court reporter 11:03 AM

Tania Cadogan said...

Nel: I know you don't want to because you don't want to take responsibility
by Sky News court reporter 11:04 AM

OP: I was there, I don't want to look. I am tormented by that... my fingers touched her head. I don't have to see a picture. I remember it
by Sky News court reporter 11:04 AM

Roux: My lady, I think that it is unfair, my client has said that he does not want to look at the photograph.
by Sky News court reporter 11:05 AM

Nel: I do not think it is unfair, my lady.
by Sky News court reporter 11:05 AM

Judge: Well, I think it is unfair.
by Sky News court reporter 11:05 AM

Judge: Can you just remove it from the screen.
by Sky News court reporter 11:05 AM

Nel: OP can we carry on?
by Sky News court reporter 11:05 AM

Judge: Just give him some time.
by Sky News court reporter 11:05 AM

Nel: OP, I understand that it is difficult. I will give him some time.
by Sky News court reporter 11:05 AM

Nel: I can see that he is distressed. I can understand that. May I ask the court that we be adjourned.
by Sky News court reporter 11:06 AM

Judge: Yes.
by Sky News court reporter 11:06 AM

Court is back in session.
by Sky News court reporter 11:31 AM

Nel: Thank-you my lady. OP let us just put on record the video. You are at a shooting range with Mr. Hougard?
by Sky News court reporter 11:31 AM

OP: We were a group of people at a shooting range.
by Sky News court reporter 11:32 AM

Nel: There was one camera behind you and one in front to video you shooting this Watermelon. What was the purpose of this whole incident?
by Sky News court reporter 11:32 AM

OP: My lady, the calibre that I was firing with was a 50 calibre. Not something that anyone can shoot with.
by Sky News court reporter 11:33 AM

OP: The purpose of this exercise, it was no an exercise. As I said earlier it was used in North America while on walking trails.
by Sky News court reporter 11:33 AM

Nel: You then said "It's a lot softer than brains" referring to?
by Sky News court reporter 11:34 AM

OP: To the Watermelon.
by Sky News court reporter 11:34 AM

Nel: But to stop a zombie.
by Sky News court reporter 11:34 AM

OP: Yes, my lady.
by Sky News court reporter 11:34 AM

Nel: In my opinion, you were referring to shooting the Watrermelon was softer than a brain.
by Sky News court reporter 11:35 AM

OP: My lady, we were enjoying the afternoon, a bunch of friends.
by Sky News court reporter 11:35 AM

Nel: Why don't you just admit, that you shot the Watermelon to see how it would feel to shooting a person in the head?
by Sky News court reporter 11:35 AM

OP: My lady, the context that was made, was in the Zombie context. Not a human.
by Sky News court reporter 11:36 AM

Nel: I thought you would say that. I would just like to know the evidence that you gave, is that what you can remember or a reconstruction?
by Sky News court reporter 11:36 AM

OP: It was what I could remember.
by Sky News court reporter 11:37 AM

Tania Cadogan said...

Nel: Are you sure it is not what you have heard and read?
by Sky News court reporter 11:37 AM

OP: My lady, what I have said is what happened. There are some things that I have heard or read, so from that I have reconstructed some of the parts of that evening.
by Sky News court reporter 11:42 AM

Nel: "Did you take into account other evidence to form your version?
by Sky News court reporter 11:43 AM

Nel: Why are arguing and not answering?
by Sky News court reporter 11:44 AM

Judge: Please proceed, the witness has already said "sorry".
by Sky News court reporter 11:44 AM

Nel: Okay, with respect. Perhaps I just didn't get it with all the objections.
by Sky News court reporter 11:44 AM

Nel: Did you perhaps not read or hear times about when you went to bed that evening?
by Sky News court reporter 11:45 AM

OP: No.
by Sky News court reporter 11:45 AM

Nel: I take it that you know the bail application very well?
by Sky News court reporter 11:45 AM

OP: Not really. I have read through it during the bail application. I was at the Brooklyn Police Station, I was very emotional at that stage.
by Sky News court reporter 11:45 AM

OP: My counsel had to read it to me. I have read it a couple of times, but I really do not want to read it to much as I was there that night.
by Sky News court reporter 11:46 AM

OP: I read it again on Monday.
by Sky News court reporter 11:46 AM

Nel: Counsel did discuss it and you agreed upon it?
by Sky News court reporter 11:46 AM

OP: That is correct, my lady.
by Sky News court reporter 11:47 AM

Nel: But you know said that there was some stuff that your counsel did not put in, what is that?
by Sky News court reporter 11:47 AM

OP: I guess there would be a lot of things. The phone call to Mr. Baba, I don't remember that.
by Sky News court reporter 11:47 AM

Nel: You said that there are certain things that counsel did not put in there? You said Reeva spoke to you and you don't remember phoning Mr. Baba.
by Sky News court reporter 11:48 AM

OP: I can't remember the others.
by Sky News court reporter 11:48 AM

Nel: But your evidence in court is true?
by Sky News court reporter 11:48 AM

OP: That is correct.
by Sky News court reporter 11:48 AM

Nel: Did you put the fans on the balcony or just the leg onto the balcony?
by Sky News court reporter 11:48 AM

OP: My lady, the fans are different. The one fan is a steel tripod fan. I put this fan with one legs on the balcony and the others in the room.
by Sky News court reporter 11:49 AM

Nel: You never went onto the balcony to retrieve them?
by Sky News court reporter 11:49 AM

OP: That is correct.
by Sky News court reporter 11:49 AM

Nel: So you never went onto the balcony and heard noises in the bathroom?
by Sky News court reporter 11:50 AM

OP: I was by the amplifier when I heard the noises.
by Sky News court reporter 11:50 AM

Nel: If somebody said that whilst on the balcony you heard noises from the bathroom?
by Sky News court reporter 11:50 AM

Tania Cadogan said...

OP: That would not be true.
by Sky News court reporter 11:50 AM

Nel: In fact it would be difficult to hear noises in the bathroom?
by Sky News court reporter 11:51 AM

OP: I am not sure, my lady.
by Sky News court reporter 11:51 AM

OP: I was by the amplifier.
by Sky News court reporter 11:51 AM

Nel: You are not following, we are on the balcony.
by Sky News court reporter 11:51 AM

OP: I was not on the balcony.
by Sky News court reporter 11:52 AM

Nel: But you said you were on the balcony when you fetched the fans.
by Sky News court reporter 11:52 AM

OP: I didn't interpret it right. Mr. Nel said that somebody saw me on the balcony.
by Sky News court reporter 11:52 AM

Nel:Is that what you heard, I said somebody saw you on the balcony? Just answer the questions.
by Sky News court reporter 11:52 AM

OP: Mr. Nel put to me earlier that somebody had seen me on the balcony.
by Sky News court reporter 11:53 AM

Nel: OP, please just answer the question. If you think or argue about other things it will get you into trouble.
by Sky News court reporter 11:53 AM

OP: I first brought the fan in and then I brought the full tripod fan in.
by Sky News court reporter 11:54 AM

Nel: Page 64, line 19. I will read it, just follow.
by Sky News court reporter 11:54 AM

OP: I woke up and went onto the balcony to get the fan.
by Sky News court reporter 11:55 AM

OP: I see, I agree with Mr. Nel, the fan was partially on the balcony.
by Sky News court reporter 11:55 AM

Nel: You see, I asked a different question. There is only one fan mentioned in the bail application.
by Sky News court reporter 11:56 AM

OP: If I can just read through it, this says that there was a fan.
by Sky News court reporter 11:56 AM

Nel: Read the application.
by Sky News court reporter 11:56 AM

OP: My lady, I don't have my full bail application here.
by Sky News court reporter 11:56 AM

Nel: I will keep this question here for after lunch, will that be fine?
by Sky News court reporter 11:57 AM

OP: Yes, my lady.
by Sky News court reporter 11:57 AM

Nel: I refer to something else, page 117. Same bail application, my lady.
by Sky News court reporter 11:57 AM

Nel: You see, you have it with you?
by Sky News court reporter 11:57 AM

OP: I do.
by Sky News court reporter 11:57 AM

Nel: Line 11, it is Mr. Roux cross-examining Mr. Botha: He went onto the balcony to bring the fan in.
by Sky News court reporter 11:58 AM

Roux: My lady, it doesn't say that in the bail application.
by Sky News court reporter 11:58 AM

Nel: But it says here that he heard a noise in the bathroom while on the balcony.
by Sky News court reporter 11:59 AM

Roux: No, the bail application never says that.
by Sky News court reporter 11:59 AM

Tania Cadogan said...

Judge: Can you just be clear from where that is from.
by Sky News court reporter 11:59 AM

Nel: Is that your version?
by Sky News court reporter 12:00 PM

Roux: My lady, that is not his version then or today. I invite Mr. Nel to read the bail application. He never said that he was on the balcony.
by Sky News court reporter 12:00 PM

Nel: I will.
by Sky News court reporter 12:00 PM

Nel: Page 64, Is that what happened?
by Sky News court reporter 12:01 PM

OP: My lady, I've just turned the page. That is correct.
by Sky News court reporter 12:01 PM

Nel: There is something wrong with that statement?
by Sky News court reporter 12:01 PM

OP: There is nothing wrong with it.
by Sky News court reporter 12:01 PM

Nel: There is, you say you never went onto the balcony. That is not true.
by Sky News court reporter 12:02 PM

OP: My lady, I did not go onto the balcony. I picked up the fan.
by Sky News court reporter 12:02 PM

Nel: My lady, I see it is after 1pm. Can we adjourn?
by Sky News court reporter 12:02 PM

Judge: Yes.
by Sky News court reporter 12:02 PM

Court is adjourned for lunch.
by Sky News court reporter 12:02 PM

Court is in session.
by Sky News court reporter 1:02 PM

Nel: Was it ever your version that you went onto the balcony to bring in the fans?
by Sky News court reporter 1:04 PM

OP: At the time, I wasn't there when my statement was drawn up. If I could I would add things to my statement.
by Sky News court reporter 1:04 PM

Judge: You are still under oath.
by Sky News court reporter 1:04 PM

Nel: I hear what you are saying, you never went onto the balcony. Why is there this difference?
by Sky News court reporter 1:04 PM

OP: In my bail statement it says that I went onto the balcony, but I went partially onto the balcony. At the time that they read it to me, I said that it was the truth.
by Sky News court reporter 1:04 PM

OP: What I am saying is that I never went onto the balcony.
by Sky News court reporter 1:04 PM

OP: My counsel did advice me that I did not have to exhaust my explanation to them. I interpreted it that it was me getting the fan.
by Sky News court reporter 1:05 PM

OP: I never went onto the balcony to get the fan.
by Sky News court reporter 1:05 PM

Nel It is a bit strange because Mr. Roux challenge Mr. Botha about this. You were present when he did this?
by Sky News court reporter 1:05 PM

OP: I was, my lady.
by Sky News court reporter 1:05 PM

Nel: Exhibit D, page 137, my lady.
by Sky News court reporter 1:05 PM

Nel: Are you there?
by Sky News court reporter 1:06 PM

OP: I am, my lady.

Tania Cadogan said...

by Sky News court reporter 1:06 PM

Nel: It is strange, because Mr. Roux said the same thing as you. "It is there, but now you have it and you see his version, did you care to test his version in the following effect"
by Sky News court reporter 1:07 PM

Nel: Why would he challenge him if that is not your version?
by Sky News court reporter 1:07 PM

OP: My version never said that I was outside to fetch the fans. I understand Mr. Roux challenged Mr. Botha about that. You can maybe ask my counsel.
by Sky News court reporter 1:07 PM

Nel: So Mr. Roux made a mistake?
by Sky News court reporter 1:07 PM

OP: I am not saying Mr. Botha made a Mistake.
by Sky News court reporter 1:08 PM

Nel: Not Mr. Botha.
by Sky News court reporter 1:08 PM

OP: Sorry, Mr. Roux.
by Sky News court reporter 1:08 PM

Nel: Why would he make that mistake, if he did not get it from you?
by Sky News court reporter 1:08 PM

Nel: The mistake here is that Mr. Roux is not guilty.
by Sky News court reporter 1:08 PM

OP: That is correct.
by Sky News court reporter 1:08 PM

Nel: There is one aspect I have to deal with, your plea explanation. You remember it was handed out?
by Sky News court reporter 1:09 PM

OP: That is correct, my lady.
by Sky News court reporter 1:09 PM

Nel: It was a 115?
by Sky News court reporter 1:09 PM

OP: I don't recall what is a 115, my lady.
by Sky News court reporter 1:09 PM

Nel: My apologise, it is an explanation. It is a court record, my lady.
by Sky News court reporter 1:09 PM

Nel: I am sending across a page, that we will deal with. "It will also be demonstrated in this trial that the scene was contaminated and we will prove this"
by Sky News court reporter 1:10 PM

Nel: That is why you are pleading not guilty?
by Sky News court reporter 1:10 PM

OP: I am not pleading not guilty because of that. This isn't the sole reason why I pleaded not guilty. I plead not guilty because I do not agree with what happened.
by Sky News court reporter 1:11 PM

Nel: When you had to decided to plead, was this a decision taken into?
by Sky News court reporter 1:12 PM

OP: No, my lady. At that time we didn;' know that the scene had been contaminated. At my bail, I gave my plea.
by Sky News court reporter 1:12 PM

Nel: Is it still your version that the scene was tampered with?
by Sky News court reporter 1:12 PM

OP: Yes, as per my counsel. There were items that were moved.
by Sky News court reporter 1:13 PM

Nel: It is not that easy. You are in the box, you tell me sir.
by Sky News court reporter 1:13 PM

OP: My lady we can go through all the photos.
by Sky News court reporter 1:13 PM

Nel: Where do you want to start. Tell me where.
by Sky News court reporter 1:13 PM

Tania Cadogan said...

OP: My lady, we can go through the photo files. Any thing that gets changed, can bother a person involved.
by Sky News court reporter 1:14 PM

OP: The cricket bat has moved, the phones have moved, the curtains had moved. The cricket bat has moved.
by Sky News court reporter 1:14 PM

Nel: Let's take it slowly, you say the cellphones had moved?
by Sky News court reporter 1:14 PM

OP: Correct, my cellphone and Reeva's cellphone. Someone moved it, my lady.
by Sky News court reporter 1:15 PM

Nel: Where was it moved from?
by Sky News court reporter 1:15 PM

OP: My lady, there were photos of the cellphone together and then a photo of the cellphones apart. The cellphone cover was moved.
by Sky News court reporter 1:15 PM

Nel: I've got all of that. Where was Reeva's cellphone?
by Sky News court reporter 1:15 PM

OP: My lady, I've got photos' of it.
by Sky News court reporter 1:16 PM

Nel: Where did you leave it?
by Sky News court reporter 1:17 PM

OP: I can't remember, my lady.
by Sky News court reporter 1:17 PM

OP: I saw people not wearing protective clothing in my house. I saw a lot of people moving in my house. That is where the contamination happened.
by Sky News court reporter 1:18 PM

Nel: Lets deal with tampered. You say the fan was tampered with.
by Sky News court reporter 1:18 PM

Judge: Are you reading from page 11?
by Sky News court reporter 1:18 PM

OP: Yes, my lady.
by Sky News court reporter 1:18 PM

OP: I didn't do it but these experts will come and testify for it.
by Sky News court reporter 1:18 PM

Nel: You cannot remember where you put the cellphone.
by Sky News court reporter 1:18 PM

Nel: Unfortunately, I have to get an answer. Are you saying the fans were tampered with? It's your case your testimony.
by Sky News court reporter 1:19 PM

OP: Please can you tell me what tamper means?
by Sky News court reporter 1:19 PM

OP: You see what I mean.
by Sky News court reporter 1:19 PM

Judge: Perhaps he is correct, please explain to him again.
by Sky News court reporter 1:19 PM

Nel: Tampering - you change something on the scene with the intention to do something with it.
by Sky News court reporter 1:20 PM

OP: Mr. Botha's task that he was the investigating officer. The scene was tampered and contaminated with. I didn't write this document, my counsel consulted with experts.
by Sky News court reporter 1:20 PM

OP: My lady, I remember the fans were running that evening, it was extremely humid that night. When the police came they said the fans were off.
by Sky News court reporter 1:20 PM

Roux: We know that the magazine was taken in the photo on the 14 and not on the 15th.
by Sky News court reporter 1:22 PM

Nel: I am sorry, how were the fans tampered with?
by Sky News court reporter 1:22 PM

OP: my lady, I said the fans were tampered with not disturbed.
by Sky News court reporter 1:22 PM

OP: So, yes, there are also photographs' of an officer plugging in his cellphone by the fan.
by Sky News court reporter 1:22 PM

OP: By the photo's that the police took, they said the fans were off. In my understanding is that some items were disturbed, some items were tampered with and some were contaminated.
by Sky News court reporter 1:23 PM

Nel: What are you saying about the fans, how did the police disturb the fans?
by Sky News court reporter 1:23 PM

Nel: I hear what you are saying but who will give that evidence?
by Sky News court reporter 1:23 PM

OP: There will be some experts.
by Sky News court reporter 1:23 PM

Tania Cadogan said...

Nel: But who will give that evidence?
by Sky News court reporter 1:23 PM

OP: Well, I am here giving evidence that some of the items were contaminated and disturbed.
by Sky News court reporter 1:24 PM

Nel: I understand, but who are these people.
by Sky News court reporter 1:24 PM

OP: I don't know them by name, my lady. I know their backgrounds. I don't always understand the terms that they use.
by Sky News court reporter 1:24 PM

OP: Where objects were moved, where the disc was taken out of the machine, tissues were placed at the side of the bed.
by Sky News court reporter 1:25 PM

OP: I understand that this is my plea, but I don't have a clear understanding of the experts. O don't have the knowledge of all that was disturbed and contaminated.
by Sky News court reporter 1:26 PM

Nel: After that, do you still know what I asked you?
by Sky News court reporter 1:26 PM

OP: If the fan was tampered with.
by Sky News court reporter 1:26 PM

Nel: No, you are not listening. I asked you, who the experts are and have you not consulted with them?
by Sky News court reporter 1:26 PM

OP: My lady, I have not consulted with them, I have sat in on meetings with them. I have explained to them certain facts.
by Sky News court reporter 1:27 PM

Nel: I am just asking about the tampering. The expert on the tampering, who will that be?
by Sky News court reporter 1:27 PM

OP: I don't know, my counsel does. There will be people who will come and say that there were certain things that could not have been there.
by Sky News court reporter 1:27 PM

OP: MR. Wolmarans will talk about items in the bathroom. There will be other people that they will also call. When I leave here in the afternoons, I am very tired.
by Sky News court reporter 1:28 PM

OP: I do not consult very much with them. I have consulted with them a lot over the last year.
by Sky News court reporter 1:28 PM

Nel: I will be very fair, you said that you worked over the last year with them and reworked with them?
by Sky News court reporter 1:29 PM

OP: I corrected myself, my lady.
by Sky News court reporter 1:29 PM

Nel: Let us look at, it is on the original photograph, 184.
by Sky News court reporter 1:29 PM

Nel: Now, those were the photographs in album 1.
by Sky News court reporter 1:30 PM

Nel: Sitting where you are sitting, was anything tampered?
by Sky News court reporter 1:30 PM

OP: My lady, I didn't see the room with the lights on that morning. So I wouldn't be able to say. There wasn't anything that was put there.
by Sky News court reporter 1:31 PM

OP: There are photos' that show the remote on the tissues and a disc was found under the bed.
by Sky News court reporter 1:31 PM

Nel: We will deal with that later. But you can't relate the room back to the day?
by Sky News court reporter 1:31 PM

OP: No, my lady. We tracked the photograph's movements through his photos' properties. The photographer was in my room and them outside for about 15 minutes and then there,
by Sky News court reporter 1:32 PM

OP: Was items that had been moved. I know there were photos' were items had been moved.
by Sky News court reporter 1:32 PM

Nel: Very interesting. Let's get to your vest. What is that next to the stand?
by Sky News court reporter 1:33 PM

OP: It is a hair clip.
by Sky News court reporter 1:33 PM

Nel: You have it there?
by Sky News court reporter 1:33 PM

OP: It is possible that it could be there, I plugged it in there to charge.
by Sky News court reporter 1:33 PM

Nel: That is also the extension cord that you used for the fans?
by Sky News court reporter 1:33 PM

OP: It is possible. I am not sure if there is a double plug behind the bed.
by Sky News court reporter 1:34 PM

Nel: We can see it there, the white cord.
by Sky News court reporter 1:34 PM

OP: That is correct.
by Sky News court reporter 1:34 PM

Nel: So you plugged the fans into there.
by Sky News court reporter 1:34 PM

OP: I am not sure if I plugged the clipper into there.
by Sky News court reporter 1:34 PM

Tania Cadogan said...

Nel: That is right, there we can see the clipper is plugged in next to the fans.
by Sky News court reporter 1:34 PM

Nel: There is only one problem there, there is no other place for the other fan.
by Sky News court reporter 1:35 PM

OP: My lady, I don't remember which fan was plugged in where. There is another plug on the other side. I can't remember where the fans where plugged in.
by Sky News court reporter 1:35 PM

OP: I don't have that independent recollection as to where the fans were plugged.
by Sky News court reporter 1:36 PM

Nel: How can you say you don't remember, you just said it a moment ago.
by Sky News court reporter 1:36 PM

OP: My memory is not good at the moment. All I can say is that the fans were plugged in.
by Sky News court reporter 1:37 PM

Nel: But one thing we can agree on, you and me, is that one fan was plugged in there?
by Sky News court reporter 1:37 PM

OP: I can't disagree. I cannot say that it was or was not plugged in. I know both the fans were working.
by Sky News court reporter 1:38 PM

Nel: Yes, let us do that. Can we just go to the other photograph, 187 and 56, my lady.
by Sky News court reporter 1:38 PM

Nel: Sorry, 61.
by Sky News court reporter 1:38 PM

Nel: Now can you see the plug of that fan?
by Sky News court reporter 1:38 PM

OP: I can see.
by Sky News court reporter 1:38 PM

Nel: It is a two point plug.
by Sky News court reporter 1:38 PM

OP: That is correct.
by Sky News court reporter 1:39 PM

Nel: That was not plugged in as there was no connection.
by Sky News court reporter 1:39 PM

OP: I see, it was plugged in.
by Sky News court reporter 1:39 PM

Nel: That is not the answer.
by Sky News court reporter 1:39 PM

OP: The cord weren't long enough to reach the wall, that is why I had an extension. That is not where I placed the fan.
by Sky News court reporter 1:40 PM

Nel: The previous photograph and zoom into the plug on the extension cord. You see there is no way that another plug could be plugged in there.
by Sky News court reporter 1:40 PM

OP: I agree, my lady. There is no way a 2 pronged plug could be plugged in there. I know that both the fans were plugged in.
by Sky News court reporter 1:41 PM

Nel: I unfortunately have to deal with this a little longer. You never unplugged the other fan?
by Sky News court reporter 1:41 PM

OP: It is possible that when I ran from the door that I tripped over the cord.
by Sky News court reporter 1:42 PM

Nel: But you never ran from the door.
by Sky News court reporter 1:42 PM

Op: I ran to the. When I ran from the bathroom to the door, opened it and called for help. After that I put my legs on. I don't remember turning the fans off.
by Sky News court reporter 1:42 PM

Nel: Let's say the other fan was plugged behind the music centre, that would not have been in your way.
by Sky News court reporter 1:43 PM

OP: It was not plugged in there.
by Sky News court reporter 1:43 PM

OP: The police could have moved it there. I am not saying that they deliberately moved the fan. At that stage they might now have thought that the fan was important.
by Sky News court reporter 1:44 PM

Nel: In your bail application you mention one thing, now over lunch you read it.
by Sky News court reporter 1:44 PM

OP: That is correct, my lady.
by Sky News court reporter 1:44 PM

Nel: Only in your plea did you mentions fans, why only now.
by Sky News court reporter 1:44 PM

OP: That is correct. I remember two days after the incident, what they decided to put into my statement and what not to put in.
by Sky News court reporter 1:45 PM

OP: They did not talk about the fans in plural. If I could go back and change it, I would.
by Sky News court reporter 1:45 PM

OP: I would rather place all the evidence in front of the court now and if I am attacked because of it. I know, it is the truth.
by Sky News court reporter 1:46 PM

Nel: You never plugged both fans in.
by Sky News court reporter 1:46 PM

Tania Cadogan said...

Nel: You are not listening, do you agree with me that that fan wasn't plugged into the lead?
by Sky News court reporter 1:47 PM

OP: I cannot agree, I can't remember.
by Sky News court reporter 1:47 PM

Nel: If you cannot agree, then show me.
by Sky News court reporter 1:47 PM

OP: I don't remember where it was plugged in. At the time of this photo the extension was full, then it must have been plugged in at the music centre. I can't say.
by Sky News court reporter 1:47 PM

OP: I remember I brought in two fans that night.
by Sky News court reporter 1:48 PM

Nel: Let's deal with something else. You referred to this incident as an accident. What was the accident?
by Sky News court reporter 1:48 PM

OP: That I discharged my firearm, at what I thought was an intruder.
by Sky News court reporter 1:48 PM

Nel: So the discharge was an accident?
by Sky News court reporter 1:49 PM

OP: That I never meant to discharge my firearm.
by Sky News court reporter 1:49 PM

OP: I never intended to shoot anyone.
by Sky News court reporter 1:49 PM

Nel: The fact that they never attacked you. The gun went off accidentally?
by Sky News court reporter 1:49 PM

OP: Mr. Nel please repeat the question.
by Sky News court reporter 1:49 PM

Nel: You never fired your gun at the attackers?
by Sky News court reporter 1:50 PM

OP: I perserved it to be intruders and I wanted to put myself between them and Reeva.
by Sky News court reporter 1:50 PM

Nel: Because you feared you shot at them, am I right or wrong?
by Sky News court reporter 1:51 PM

OP: I never shot at them, I never meant to shoot at someone. I heard a noise and believed that the person was coming to attack me.
by Sky News court reporter 1:52 PM

Nel: We started at " I discharged my firearm accidentally"
by Sky News court reporter 1:52 PM

Roux: My lady, he never said that.
by Sky News court reporter 1:52 PM

Judge: I am not sure you are correct, Mr. Roux.
by Sky News court reporter 1:52 PM

Roux: Then I did not. I will come back to you in the morning.
by Sky News court reporter 1:53 PM

Nel: I agree with you my lady.
by Sky News court reporter 1:53 PM

Nel: Did your gun accidentally go off or did you fire at the intruders.
by Sky News court reporter 1:53 PM

OP: I had my finger on the trigger, it was an accident what happened. Before I could think, I fired my firearm.
by Sky News court reporter 1:53 PM

Nel: The only way out for you to shoot this intruder to protect yourself?
by Sky News court reporter 1:54 PM

OP:I didn't have time to think.
by Sky News court reporter 1:54 PM

Nel: I will go through the details. The court will not accept it, let's try again.
by Sky News court reporter 1:54 PM

Nel: Let's get one thing out of the way. Did your gun go off accidcentally?
by Sky News court reporter 1:54 PM

OP: When I fired my firearm, I believed that someone was coming out to attack me. I thought that somebody was coming out to attack me.
by Sky News court reporter 1:55 PM

OP: It is easy now to sit back and think what I could have done. But at that moment, I didn't have time to think.
by Sky News court reporter 1:55 PM

OP: I don't know. When I heard a noise before thinking our of fear fired 4 shots. When I realised the scale of what was happening I stopped firing my firearm.
by Sky News court reporter 1:56 PM

Nel: Why are you now being emotional, why now?
by Sky News court reporter 1:56 PM

Judge: Just stop now. he has been emotional through out.
by Sky News court reporter 1:56 PM

Nel: Okay, it is almost time for the adournment. I don't know if you are thinking of what Mr. Nel is going to ask and already thinking of an answer. Am I right?
by Sky News court reporter 1:57 PM

OP: I am saying at that time, I didn't know what to think. I believed a person was coming out to attack me.
by Sky News court reporter 1:57 PM

Tania Cadogan said...

Nel: You are not answering me, are you thinking of the implications of what I am going to ask you?
by Sky News court reporter 1:58 PM

OP: My lady, I am sitting here and thinking about my life.
by Sky News court reporter 1:58 PM

Nel: Your life, Reeva doesn't have a life now. I ask you again.
by Sky News court reporter 1:58 PM

OP: I didn't intend to shoot at anyone. On that basis then I will agree, it was an accident that I fired the firearm.
by Sky News court reporter 1:59 PM

Nel: You never purposely fired shots at the door?
by Sky News court reporter 1:59 PM

OP: No, I did not.
by Sky News court reporter 1:59 PM

Nel: Then that is it for today. I just want to show you something. I refer to the bail application. Exhibit D. Page 65.
by Sky News court reporter 2:00 PM

Nel: Line 21, next part at line 19. ""I felt trapped as my bedroom door was locked...I fired shots at the toilet door..." Why would you say that?
by Sky News court reporter 2:00 PM

OP: I don't understand.
by Sky News court reporter 2:00 PM

Nel: Why would you say you fired shots at the door?
by Sky News court reporter 2:01 PM

OP: It is obvious, my lady. I fired shots at the toilet door.
by Sky News court reporter 2:01 PM

Nel: I asked if you deliberately fired shots at the toilet door and you said no, but now you say it is obvious.
by Sky News court reporter 2:01 PM

Court adjourned.

My apologies for the long transcript posts

I think the transcripts are ssslightly different as the one i posted doesn't match what the independant is running

Here we hear his reflected answer to a question making it unreliable

Roux: OP did you intend on killing Reeva?
by Sky News court reporter 9:30 AM

OP: No, my lady, I never intended on killing Reeva or any-body else.
by Sky News court reporter 9:30 AM

next we have him avoid answering a question

Nel: You killed her. You shot and killed her.
by Sky News court reporter 9:38 AM

OP: I did my lady.
by Sky News court reporter 9:38 AM

Nel: So say it, you shot and killer her.
by Sky News court reporter 9:38 AM

OP: I did, my lady.
by Sky News court reporter 9:39 AM

Pistorius: I never intended to shoot anyone. I wasn't meaning to shoot anyone. Went to bathroom to put myself between danger and Reeva.
Notice the dropped pronoun in relation to going to the bathroom

GN- But as a Christian, you will not lie.

OP - I will try not to lie my lady, as I said, I’m human. I’m here to tell the truth.

He said it all. He was unable to issue that reliable denial

I'm still reading but he really avoided the question asking if he went into the kitchen.

Anyone know why he was even asked that? Clearly it was sensitive. I mean that was an easy question I would think but odd that it had any need to be asked unless there was something about the kitchen.

Also, I really wonder what went on in that stall after he got the door open. It seams like he tried to delay. Tried to lift her, then called some other than 911 (or what ever they have there). Was he making sure she was dead before he called? I wonder...

Hmmmm the crying and wailing at the trial and the constant reference to himself screaming adn crying make me think that Reeva was not only screaming but crying loudly enough for the neighbours to hear :-( Pisorius is demonic.

Has anyone noticed how hard it is for him to construct a sentence that doesn't begin with 'I'

Why did he feel the need to retrieve her phone from the toilet? To see who she called and wipe it? Or did he throw her phone in the toilet himself?

Problem he has is WHY would she have her phone while sitting on the toilet?

Why did he go into the kitchen?

''I'll try not to lie''!!!!!

I think he had been in the kitchen and they were fighting, and she ran into the bedroom and that's when he started shooting. (That's the only explanation for the blood splatters on the bedroom ceiling.) Then she grabbed her phone and ran into the toilet and locked the door. She was hiding from him. (Obviously, she wouldn't have taken her cell phone, and locked the door if she'd just gotten out of bed to pee in the middle of the night.)

After she locked herself in the toilet, she opened the window so she could escape through it.
Oscar heard the window open and knew she would escape and tell the police what had happened, so he started shooting through the door to prevent her form escaping through the window.

For the same reason, he waited until he was sure she was dead to call the police. He didn't want her to tell police what he'd done to her.

Five minutes between the time he fired the fun and fetched the cricket bat? That would be an eternity in a situation like that.

Angelina said...

Anon, I noticed that too: why did he take her phone from the toilet and try to unlock it. I also noticed that he says he handed her purse to the woman and then says "I did not go through it." It does seem like that may have been what prompted the shooting was her not letting him search her phone and/or purse.

The sitting and standing thing people are pointing out I don't find suspicious, as this is a man with no legs, so from his perspective this would be something he notices more than most people, whether he is sitting or standing.
One thing I wonder though, if he had been attempting to kill Reeva as an act of domestic violence, why would he have attempted this homicidal act at a time when he did not have his prosthetics on? What I mean is, if this was his ultimate power play, to shoot and kill her, especially himself being an athlete wouldnt he have put the prosthetics on first to put himself in a more powerful position with Reeva as well as the authorities who would show up?
I do believe he is an abuser but I am just not sure if his story is a lie.
I read how his mother used to sleep with a gun under her pillow as Pistorius's father was often away, and she would sometimes get paranoid at night there was an intruder and wake up the kids and being them in her room. Is it possible she passed that paranoia down to him and then combine that with his being vulnerable because he is missing his legs, maybe he actually was irrationally paranoid of sounds in the night/intruders/etc.?

However, he is introducing so much extraneous information, to much to list here, and as we know. For the analyst, it is doubly important.

trustmeigetit said...

Here are a few more things I see that stand out to me.

*******************************************************

OP: I am not pleading not guilty because of that. This isn't the sole reason why I pleaded not guilty. I plead not guilty because I do not agree with what happened.

Interesting he does not state that he pleaded not guilty because he didn’t intend to kill Reeva. Just that he does not agree with what happened.

Odd.

*******************************************************

I also don’t understand why he is being evasive about going onto the balcony and how many fans were involved . Like with the kitchen from my earlier comment….. It does not seem to make any sense why so much question about it and why he is being so evasive about answering the questions.

If the fan was on the balcony, why would he care if he just grabbed it or went out on to it. It to me seems so very irrelevant …….UNLESS….. he brought the fans in after the murders to fit his story. It just seems like an odd thing to be evasive about. So, there must be be a reason.

His initial statement was “I went onto the balcony to bring the fan”

Now in court he stated “I never went onto the balcony to get the fan”

He used the same word. ONTO. There is a reason that he does not want to place himself “on” the balcony before the murders. But not sure why yet.

*******************************************************

OP: It is possible that when I ran from the door that I tripped over the cord.

Nel: But you never ran from the door.

Op: I ran to the. When I ran from the bathroom to the door, opened it and called for help. After that I put my legs on. I don't remember turning the fans off.

He states “it is possible” vs telling us what happened. He is giving one possible version. But is not stating that is what happened. Also, he comments that he ran from the bathroom to the door. How did he run? He was on stumps at this point he claims. He said he has no ability to even stand and hold the bat.

Now lets look again at his original statement:

"When I reached the bed, I realized that Reeva was not in bed. That is when it dawned on me that it could have been Reeva who was in the toilet. I returned to the bathroom calling her name. I tried to open the toilet door but it was locked. I rushed back into the bedroom and opened the sliding door exiting onto the balcony and screamed for help. “I put on my prosthetic legs, ran back to the bathroom and tried to kick the toilet door open.

So there is no confusion, he initially stated that he went to the balcony and screamed BEFORE he put his legs on.

So 2 things. Not only how did you “run” from the bathroom to the balcony to call for help on your stumps (remember he says he can stand but has limited mobility so I think running is out of the question). And had he “tripped” on the fan thus unplugging it, not only would he have stated that… vs stating “it is possible he tripped”. But, if you are on stumps, I don’t see you have the force to trip. And if he was in his prosthetic legs…. Well, they don’t just stand right back up, so he would have really struggled to get back up. I do not think this would slip his mind .

*******************************************************

Also, initially he stated: " "I noticed that the bathroom window was open. I realized that the intruder/s was/were in the toilet because the toilet door was closed

Now in court he is stating that he “heard the window open” before he began shooting.

I stand by this being so very critical and should have been one of the first things he stated if it was true.

If I heard a window slide open in my home, that would scare me. But hearing someone make a noise in the small toilet stall would not. I would assume it was my husband going to the bathroom.
This is too important for him to have forgotten had it been true. I think he added this to make his story seem more like an intruder since his story before sounds ridiculous .

" I made a mistake"

That is what Oscar said. A mistake. Just one. However, if everything really happened the way he is telling us, he must have gone through numerous scenario's that would have prevented this outcome.
If only he had put on the light. If only he had interpreted the sounds in the bathroom as - even possibly - coming from Reeva. If only he had made sure it was not Reeva. If only he made made sure the ladder under the window was removed. If only he had waited for Reeva to answer before starting to shoot. If only he had just fired a warning shot. if only he had not shot four times, but shot just once and waited for the reaction. If only he had decorated his room to have a light source in the middle of the night. If only he had not asked Reeva to come over that night. If only Reeva had not drunk this last glass to make her need to go to the bathroom in the middle of the night. if only, if only, if only.
Numerous mistakes, that each would have prevented this tragic outcome.

But Oscar only admits to one mistake. Killing Reeva.

Oscar Pistorius's claims about night of shooting 'improbable'

Read more: http://www.theweek.co.uk/world-news/oscar-pistorius/53387/oscar-pistorius-told-explain-reevas-unhappy-messages-live#ixzz2yV1xPQBM

THE claims made by Oscar Pistorius about the night he killed Reeva Steenkamp have been described today as “so improbable" that no one would ever think they were true.

The athlete faced a third day of brutal cross-examination from prosecutor Gerrie Nel, who repeatedly accused him of lying and attempted to portray him as a reckless egotist, who would blame anybody but himself.

Noticed something else:

So he states “Just before I got to the wall of where the tiles start in the bathroom I stopped shouting” THEN “I heard a toilet door slam”. Lets just say this was true. What he is saying is he was shouting BEFORE Reeva went into the toilet and closed the door and there is no way in H#$$ she didn’t hear him and just walked into the toilet stall and shut the door.

He is making it worse every time he adds. Rather than make things make more sense, he is making it look more like a story he is adding to as he goes along.

trustmeigetit said...

Angelina…

He claims there were people working on his home and they left the ladder.

Angelina said...

Trustme, Thanks for the info. So much is very strange, even the open bathroom window: is it possible he himself could have opened it? If anything it makes him look bad like Reeva had opened it to try to escape him. It doesn't help
his case.
The phone fell in the toilet and he took it out? And tried to use it? Doesnt he realize this also makes him look bad?
The door of the bathroom was locked?
Why would she lock it? Unless she was scared of him?
Does anyone really know if he had his legs off when he fired the gun? I do think it would be odd ( certainly not inconceivable) for him to do this assault without his legs on, but since he claims he put his legs on after the assault how do we know they were off at the time of the shooting?

I have some questions re:the broken arm. Exactly why was her arm broken? I wouldn't think a bullet would have broke her arm. Does anyone know? That is one of the first things he says he notices when entering upon the bathroom is noticing her broken arm hanging there. It leads me to think that this is very sensitive to him.
Here is some conjecture:
Oscar and Reeva get into a volatile argument, he breaks her arm. She runs into the bathroom and locks the door to get away from him. By now he already in a severe rage, he's aware that she is could bring him down and in his mind that can't happen so he picks up his gun and starts shooting......I guess this could be plausible??. More than his story in my opinion. I have to say how many times do we as humans jump right out of bed without our eyes adjusting to the darkness and getting our bearings. The only time I have ever done that is when one of my little houdini's (babies) were not in their beds. Oscar wasn't scared when he went to get the fan. So he had time to get his bearings. This whole I didn't know, couldn't see, doesn't sit well with me. Also he keeps using the word vulnerable. I wonder if its because he did hurt her before she went into the bathroom and as a result could have ruined his reputation. Which would make him vulnerable. From everything that I have read, I get the feeling that his reputation or standing in the community was the utmost importance to him. He didn't want to be sullied an shape or form.

trustmeigetit said...

Angelina and 5emerald29 ….

I do think that everything he has said makes no sense at all. I think he did open the window as it was part of his theory.

Also, I think that he is trying to explain things away and in doing so, is changing his story and making him look less reliable.

The legs.. I think its likely they were on. I really think he chased her into the bathroom. The door being locked as my main reason for this. My ex was abusive. I often used the bathroom for refuge and I always locked the door in there. That immediately stuck out to me. To lock it in the middle of the night makes no sense. Unless she was scared. I think she was. I also think that's why her phone was with her. I think she was going to call for help. I think she was standing and the first bullet hit her and she dropped it in the toilet.

Then the broken arm… I have not seen anything about this more in detail, but I really believe that he initially hit her with the bat. There is blood on this and on the bedroom wall. I think she was running from him to the bathroom after this. I think he then tried to get to her by breaking the door then shot when it didn’t work. Its possible he broke her arm with the bat. But I also think I read something about her arm being hit by one of the bullets. I think that could have broken her arm? But not sure.

trustmeigetit said...

I looked for more info on the arm...

Here is what I found. Still not sure how there was blood on the bat and the bedroom wall if she had not been assaulted prior to being in the toilet tho.... So I think that has yet to be explained.

Mr Botha outlined that the forensic evidence shows there were three bullet wounds: one on the right hand side of the head above the ear, one in the elbow which broke her arm, the third in her hip.

A cricket bat “was used to break down the top part of the toilet door” but an autopsy of Miss Steenkamp gave no indication she had otherwise been assaulted.

Anonymous said...

Couldn't they tell if he had his legs on by where the bullet holes were?

Saw something VERY critical in the testimony. Not sure if this was today. But I pasted the section below.

Now… not only is he saying he asked Reeva to bring the fans in……But that after they fell asleep, HE WOKE UP and Reeva was a awake. He then got up and brought in the fans. Yet now ESPECIALLY SINCE SHE WAS AWAKE, it didn’t dawn on him that it may have been her in the rest room. HELLO!

Nel didn’t seem to pick up on this.

OP: I got into bed, I was slightly looking at what Reeva was looking at on her phone. We just sat there chatting, like a normal evening.

OP: Then I retired and I said to Reeva that I was falling asleep. I asked her if she was tired, so I lay on her stomach and asked her to bring the fans in.

OP: When she goes to sleep. Then I fell asleep.

(I didn’t include the talk about where the Ipad was on the floor)

Nel: Do you know what woke you up?

OP: I thought it was the humidity.

Nel: You never said that you woke up to a noise?

OP: No, my lady.

Nel: You never said that you woke up in a cold sweat?

******************************

OP: No. my lady. I woke up and she was still awake. She rubbed me on my forehead and asked if I can't sleep baba. I replied "No I can't"

***************

Nel: And you never discussed the fact that she never brought in the fans?

OP: No, my lady.

Nel: How was the lights in the room?

OP: The lights were off.

Nel :Except for the light on the balcony?

OP: Yes, my lady. There was light eliminating. I could see the jeans on the floor.

Nel: When you woke up you were on the left hand side of the bed?

OP: That is correct.

Nel: She was on the right?

OP: That is correct, my lady.

Nel: You then got up and walked around?

OP: That is what I said, my lady.

Nel: Then you got the fans inside and locked the door and closed the curtains?

OP: That is correct.

Nel: There was nothing bothering?

OP: No, my lady, I drew the curtains closed.

Nel: And Reeva didn't say a word after that?

OP: No, my lady.

Nel: Can you didn't say a word?

OP: No, my lady.

Nel: Why not?

OP: I had my back towards her.

Nel: You were about 2metres away from her and you didn't see her get out of bed?

OP: No, my lady.. I can't say which side she climbed out of, it could have been at the foot of the door.

Nel: How could you not have seen her?

OP: The room was pitch black.

Nel: And before you closed the curtains, you could still see her?

OP: My lady, I had my back to her.

Nel: So, you locked the door and closed the curtains, in that time she got up and you say you didn't see her?

OP: I don't know when she got up. It was pitch black. There was only a light coming from the amplifier.

OP: No. my lady. I woke up and she was still awake. She rubbed me on my forehead and asked if I can't sleep baba. I replied "No I can't"

So...aside from the obvious change in his story from her being asleep.... Now not only awake but "still awake"

I think this is maybe when the fight started? About what we may never know.

He also tried to say at one point he may have not heard her get up because on his stumps his head is about the level of the fan.

But... U just brought in the fans (the other change from fan to now fans) so they are not on. If I am awake... I always hear my husband get up. And we sleep with a floor fan on every night

Thanks for the info update on my question.

Anon..you would think so. There is a conflict there. But it appears it could have been either on or off.

One of the first things that stood out to me too, was him noticing her broken arm. Has there been any other mention or news about that, or just his one mention of it?

Unless it was so oddly out of shape, mangled, or the bone through the skin, how would he know right off, just by looking, that her arm was broken? Obviously it was just the two of them in the house, him with all the weapons, her hiding from him, pretty obvious he broke her arm. I think whoever pondered if he broke her arm, and she then ran and hid in the bathroom, seems very plausible. I can't think of how else her arm got broken. Not from a bullet, right? Not from him hitting the door, right? I also question his immediate knowledge of her broken arm, and that being one of the first things he notices. - Has it been said how many bullets, and if they all went through the door first?

Regarding Reeva's broken arm:

Medical examiner revealed that she was not beaten or struck prior to the shooting.

The bullets Pistorius uses are "flesh-tearing," and they open up into a mushroom shape once they are embedded into someone.

According to the medical examiner, the bullet ripped through her arm, essentially amputating it. It was hanging from her body.

----------

I have been watching the trial with an open mind, but SO many pieces of evidence are working against him. Pretty soon, they stop becoming coincidences and start revealing a pattern . . . all pointing in one direction: GUILTY.

1) Forensics determined bullet holes came first, then cricket bat. Neighbor's testimony seems to support this, since the first set of sounds she heard were in very rapid succession, so it is unlikely to have come from a bat. Four bullet holes. Two different sets of neighbors reported that they sounded like, "Bang . . . bang, bang, bang."

Prosecutor argues that he would have heard her screaming and could have stopped, since the first bullet hit her in the hip. (Later bullets would have rendered her unable to scream, as she was shot in the brain and her airways filled with blood).

2) Reeva was hit in the right front hip. She was STANDING and facing the door when she was shot, so she sure as heck wasn't in there to use the bathroom.

3) Pistorius claims they got ready for bed together and then fell asleep. He woke up later to bring the fans in, after which he claimed to have heard an "intruder." Reeva was in her street clothes and NOT dressed for bed when she was found dead, casting doubt on Pistorius's story.

4) Reeva was found with her cell phone, and the bathroom door was LOCKED.

5) Neighbor woke up at 1:56a and heard an extremely loud argument. At 3a, three sets of neighbors reported "petrified" screams from a woman like she was "being attacked." She was "screaming for her life." Then, they heard shots fired. After that, they heard a separate man's voice, putting a hole in Pistorius's defense that he screams like a woman when distressed. (Lol, desperate much? He's really reaching there.)

6) The key to unlock the toilet door was also in the toilet room with Reeva.

7) Pistorius claims it was completely dark in the room, even though neighbors saw his bedroom lights on during a loud argument at 1:56a. Also, note that he claimed he and Reeva were asleep at this time.

Thank you for that explanation, I've been so curious about her broken arm.

I would like to address two things that were said here. You have to be open minded to take them in consideration.

1. Why did Reeva took her phone with her?
a) some people do take their phone to the bathroom to check their messages. Myself included.
b) The TOILET light was broken, not the bathroom, but the toilet light. So she used her phone as a flashlight.

2. Why did Reeva locked herself in the toilet?

Assuming that OP version is true, this is what I think might have happened:

Reeva went to the bathroom. She relieved herself, because according to the autopsy she didn't have urine in her bladder at all, which indicates that she peed before she was shot.

Back in the bedroom, OP hears a noise, takes his gun and goes to the bathroom.
OP said he was shouting to the "intruder" to get the f*** out of his house.
What if Reeva heard him, but could't know that OP thought the "intruder" was in the bathroom. So she locked herself in the toilet and kept silent because she was scarred of the "intruder" she thought OP was chasing? And it also makes sense in this scenario that she was standing in front of the door.

This is what I would have done if I would be in a room/bathroom and hear my boyfriend shouting to someone to get out of the house.
I would lock myself in and stay in silence, to not give my position or presence away.

All of this don't make any sense if OP is not telling the truth.

And I have a question myself:
If she run to the toilet scarred of OP and obviously had the phone with her, why didn't she called somebody for help? Because both the prosecutor and the defense agree that he wasn't wearing his prosthetic legs when she shot her. He clearly took longer to go to the bathroom than Reeva, so she had enough time to place a call, even if she wouldn't have time to talk before OP shot her? Why didn't she?

What really bugs me is the absence of a proven MOTIVE. Nel's assumption that a fight took place is not enough for me. Because for his version to be true he must assume an argument took place, but he can't prove it.
Before anybody can attack me :), Nel had witnesses who claim they heard an argument, woman screaming, but the defence will have OP 2 closest house neighbors testify that they din't hear any argument, nor a woman scream. Who to believe in this case?

OP was media paranoid. He was very careful with his public image. The restaurant gunshot, when he told a friend to take the blame for the incident so it wouldn't go out...

So suddenly he has an argument with his gf and shots her, without realizing that his "hero" image will die too the very same second regardless of what story he tells?
There is no proof OP physically abused against any of his previous girlfriends or Reeva, and out of nowhere one night OP wakes up and says to himself: "Well, this chick pissed me off, I'm gonna kill her. The h*** with my career or my public image". Because Nel says it was premeditated, not that he lost his mind. Premeditation implies he consciously killed her. He made the conscious decision to kill hell, meaning he was aware of the consequencies.
I just don't buy it. Something doesn't sit right to me.

I'm not saying OP is innocent, far from it. At the end of the day he killed Reeva. But looking at both versions (the state and the defense), it makes a little more sense to me his version.

I admit I could be very wrong and OP is cold blood murderer. But what if I'm not?

and closed the sliding doors, the blinds and the curtains. I heard a noise in the bathroom and realised that someone was in the bathroom.
