Tammy Moorer Seeks New Bond Hearing

not starving in jail...is there another explanation?


Tammy Moorer has asked for a reconsideration of her bond denial.  Her attorney claims she has "new and substantial" reasons for relief in the bond that was originally denied.

"The Defendant requests that this Honorable Court hear new and substantial grounds for relief relating to the denial of bond and hear grounds forming a basis of the immediate necessity."

"In compliance with Judge John's March 21, 2014 order prohibiting extrajudicial statements and release of documents, a memoranda of facts and law will be forwarded to the court under seal for the court's consideration.  This memoranda of facts and law has not been furnished to the state."

The absence of illicit substances in the body sometimes does amazing things. Pregnancy could also be the explanation.

I will reserve my impressions and opinions of TE. I posted it here once and it was deleted. Peter has asked that no one say anything potentially insulting or upsetting to TE so I will abide by Peter's wishes. I will say I don't believe he had anything to do with his daughter's disappearance and I do feel sorry for his pain.

For those who continue to insist they see 'deception' in Terry Elvis' statements:

-Sensitivity does NOT equal deception.

A subject's language can show sensitivity which has nothing to do with deception, guilt, or guilty knowledge.

She's a full blown narc PD. They are evil. She'll gamble on here ability to deceive. That is her life. Sidney I pity, he broke human moral code, but as a fellow victim, I will say he must pay but he has my empty sympathy. A Tammy broke me, but I stood up and fought.

Tammy isn't pregnant - she's overweight. I saw the original post on Facebook that started the rumor that Tammy is pregnant and applied all that I've learned from here. I came to the conclusion that the subject (the person who posted the message) was being deceptive.
Can anyone say 'reasonable doubt'?

If u looked at Mr. Elvis' first interviews he describes Heather and him being artistic... Sharing that trait, that was a big part of their bond. His line of work, his poetry, etc... Heather's friends descibed her that way. Your best hairdressers are the ones that have been described as artistic all their life. As we all know, many people become licensed hairdressers. And as we all know, many had no business acquiring their license because they suck at it! What I am trying to say is, lay off Mr Elvis. His communication for his missing daughter was his last and big connection and shared trait with his missing daughter. If you can't see the father's bleeding heart reaching out for his missing daughter, you never will. IT was their language. Their language they shared together.

Basically, can the crap. You say you wonder about the harassers intent on Mr. Elvis? Ask yourself what's your intent? You are doing the same thing to this man. You are giving him hell for loving and calling out to his daughter in their shared language. Hear all of ur yourselves.

Was it noted that Mr. Elvis didn't do that welfare check? Not every little aspect of a case is in the media. Bits and pieces on both sides are not reported on. Just cuz u didn't read about it doesn't mean it didn't happen. Maybe the welfare check is not reported on cuz it is an important part of evidence that involved the local police with the father. Maybe the start of very important evidence was attained at that time.

My guess is Tammy Moorer is seeking bond for prenatal care outside of the jail. She is probably going to claim because of her age and stress she needs better medical care than the state can provide.

It makes perfect sense that Tammy used a pregnancy to hold on to Sidney when she would try by handcuffing him, threatening suicide, and eventually murder of her rival.

There are red flags everywhere, his language and his behavior.

watching it reminded me of susan smith and also kristi abrahams who along with her hubby (Keisha's stepdad) murdered her daughter Keisha.

I had to ask my aussie mate to tell me what he said at the start, he says she is tiny , tiny. What a strange thing to start off with.

It aslso caught my attention that he says it has to be someone who knows me (not us?)and knew she would be asleep in front of the tv ( not in her bedromm as would be expected?)
How did they manage it without disturbing the 2 sisters? Also her cuddly toy and sleeping bag are missing ( any bets she will be found in it?) They need to poly the father annd also ask when she was last seen alive by an independant witness and also ask the sisters what they saw or heard that day and earlier.

Garth Campbell says there is no way his youngest daughter could have left their family home alone.

When he awoke on Thursday morning, Chloe, who usually sleeps in the lounge, was missing.

A window was open and when he looked out, an adult-sized footprint was on the car.

Chloe's sleeping bag - patterned with wizards and dragons - was gone as well as her trusty companion, a stuffed toy dog named Gnarly.

"I don't think there's any possible way she's wandered off," Mr Campbell told AAP.

"She wouldn't leave the yard by herself."

The family usually shuts the windows of their Childers' home at dusk each night to keep out mosquitoes, but on Wednesday Mr Campbell believes one of the latches must not have caught.

"That's why we are blaming ourselves," he said.

Chloe's two older sisters Janae, eight, and Britney, five, have their own room in the two-bedroom Childers house.

But on Wednesday all three girls slept in the lounge.

When Janae awoke to go to the toilet in the morning, Chloe wasn't in the lounge room, Mr Campbell said.

Janae had thought Chloe had sneaked into her parent's room as she had been sick lately.

A distraught Mr Campbell believes that someone who knew where Chloe slept took her.

"I think it's got to be someone who knows me, in how they got in, where she sleeps," Mr Campbell said.

"They knew she was sleeping in front of the TV."

Mr Campbell is asking for prayers and is clinging to hope that if Chloe's been abducted, she is being cared for.

"I hope someone that's taken her is looking after her," he said.

"Giving her brekky, lunch, I don't know, I don't know what to think.

"Maybe someone took her who can't have kids or something like that."

Mother Tammy Campbell reported Chloe missing at 7am Thursday.

A major land and air search is underway and will go into the night.

Police tape has been placed around the house and the nearby showground is being searched.

"We hold very serious concerns for the safety for the little girl, as we do for every missing person reported," Inspector Kevin Gutteridge said.

Childers, about a half hour drive southwest of Bundaberg, has a population of less than 1500.

Why are we forbidden to use specifically laid out rules of statement analysis on Mr. Elvis's words?
Aside from specific SA applications, it is often said his heart is bleeding for his daughter and those who can't see that are terrible, heartless people. Well, I don't have a calculator but at least 95% of what he writes is about himself, not Heather and not his wife, who must be suffering terribly over Heather being missing. Do you think at some point Terry will mention his wife and her heartache? Or is his never mentioning his wife just another thing that is part of his poetic style? Poets usually have sensitive hearts. Kind of odd how his writing does not show sorrow for his wife's agony that I'm sure she is feeling over the loss of Heather. In fact he does not even mention his wife. Is this "unexpected"?

I'd like to correct myself. Terry actually did mention his wife once and wrote that he is sure she is having terrible dreams like he is but he does not ask her what her nightmares are because he's sure they are the same nightmares he has. Other than that, I dont recall any mention of his wife. Is it callous of me to notice this bizarre omission?

I posted this in the oscar post but with several new posts I don't know if it will be seen.

Bit this was huge. Oscar gave sme testimony yesterday and stated that Reeva was "still awake" when he woke to get the fans. It didn't seem to get the shock from Nel unexpected since he's always claimed before she was asleep.




OP: I got into bed, I was slightly looking at what Reeva was looking at on her phone. We just sat there chatting, like a normal evening.

OP: Then I retired and I said to Reeva that I was falling asleep. I asked her if she was tired, so I lay on her stomach and asked her to bring the fans in.

OP: When she goes to sleep. Then I fell asleep.

(I didn’t include talk about where the Ipad was on the floor)

Nel: Do you know what woke you up?

OP: I thought it was the humidity.

Nel: You never said that you woke up to a noise?

OP: No, my lady.

Could Reeva have been or expressed the thought to him that she might have been pregnant? Could he have feigned happiness by placing his head on her stomach but inwardly have been enraged?

CHLOE Campbell who went missing from her Childers home on Thursday has been found alive.

Police have confirmed the three-year-old “wandered home” just before 1am Saturday morning and has been taken to the hospital to be checked out.

Police are expected to make a statement shortly.

Chloe was discovered missing in her Childers home about 7am Thursday.

Earlier, The Courier-Mail reported that security footage has emerged of two men and a young child walking about 200m from where Chloe Campbell disappeared in Childers.

A residential security camera captured the vision very early on Thursday, the morning the three-year-old is believed to have been abducted from her house.

As fears for Chloe’s safety intensified yesterday, her inconsolable mother Tammy O’Donnell described her anguish at not properly locking the lounge room sliding window the night before.

Relief as little Chloe found safe and well

The glass window was found open and Chloe missing about 7am on Thursday after she and two siblings fell asleep on a lounge room mattress.

Ms O’Donnell said she usually checked that all windows of the medium set house were clicked shut before retiring to bed.

“I shut the house up that night but I don’t think, when I’ve closed it, I don’t think it’s clicked,” Ms O’Donnell said.

“I think I just shut it and I usually check it before bed and I don’t know why I didn’t that night.

“I just think if I had have checked, she’d still be here.”

The extensive search for any sign of the blonde toddler has expanded further around Childers as Ms O’Donnell said she did not believe her daughter was in the town but “further out”.

Police will sift through the local tip where the family’s and town’s waste was dumped after collection on the morning of the little girl’s disappearance.

Inspector Kev Guteridge said yesterday the team of police, SES and volunteers had not located anything by air or on land.

Investigators are reviewing CCTV footage from town and following leads from the public.

Childers resident Les Fennell handed his own personal security footage to police after they requested he scan it for anything unusual.

Mr Fennell said he uncovered two men and a young child walking south by the railway line behind Pioneer Park, a travellers’ resting park on the Bruce Highway.

The location on the northern end of town intersects Ridgway Street where Chloe went missing.

Mr Fennell said the child was walking about 15m ahead of the men as they passed behind a toilet block as dawn approached.

About twenty minutes later the men returned north in the direction they had come but without the child.

“What I saw was the council worker doing his work, and left. Then came two men and a child. It could have been for any reason and anyone’s child,” he said.

“The sun had just started coming up yesterday morning and it was about the same time the child was missing.”

Mr Fennell said the child seemed to know the men as he or she appeared to be leading they way.

“She or he was very small,” he said. “The child looked like it knew where it was going and the two men followed.”

Mr Fennell said he compared that morning’s discovery with footage from the previous four days but did not see the trio on any other day.

The footage, which was wavering between night vision and regular, was not clear enough to determine if the child was a girl or boy, whether it was carrying a toy or the ages of the men.

The discovery comes as Ms O’Donnell is convinced someone knows where Chloe is, pleading for made an emotional plea for them to be “honest enough” to return her.

“I’m hoping she comes home safe, it’s all I’ve got at the moment is hope and hoping someone will be honest enough to bring her home,” she sobbed.

“Have the guts to bring her home. They were gutsy enough to take her, now have the decency and the guts to being her home.”

Overcome by grief and tears, Ms O’Donnell said she hadn’t been able to eat or sleep as she lived out this nightmare.

She said the family usually lived a quiet life, revolving around school and home and did not have enemies.

Ms O’Donnell affirmed her husband’s belief that whoever took the child was known to Chloe, and she was unlikely to have wandered.

“They carried her out while she’s been asleep, she’s obviously known them to not scream or yell out,” she said.

“I’d just like to say if anyone out there had any info please come forward and can you please just please bring her home ... or just drop her somewhere and ring up ... she needs to be home with her family.”

"My lady, I'm giving him the witness time to console himself," Nel told the judge. "He is distressed, I'll wait a bit."

His voice tearful, tremulous, he struggled to enunciate the words. "My lady," he said, "at no point did Reeva shout out, or scream. I wish she let me know she was there; she did not do that.


Unreliable denial, he reflects the question back to the prosecuter as his answer.

He is very good at throwing a question out there and standing back and listening. When OP gives an answer, GN doesn't move on straight away. He pauses for what seems like an hour (30 secs) and OP cant help but fill the silence, and adds more words that are needed, thus disclosing more information. I believe, this is how GN is playing him. Very clever man.

Something small I just noticed. He heard not “the” toilet door slam, but a “toilet door”. Now assuming these were his exact words, it appears he is not committing to his actual door. Since he has just one toilet door in that bathroom, it should be “the toilet door”

Thank you Hobs for the news of Chloe's safe return. After the first day it didn't look like a good outcome for her so this is great news. I wonder where she was?

I agree Mr.Nel is doing a good job. He is giving OP lots of rope to hang himself with, then he calls OP on his lies right there and then. Oh the squirming! Some moments remind me of CA almost, like the story of being shot at 5 years ago but, darn, I can't remember who I called to help me! He uses the old I can't remember, I'm too tired, it happened so fast etc excuses to avoid testifying.
I hadn't realized how small the toilet area where Reeva was in was, poor lady had no where to go. When Mr.Nels described OP yelling at her, knowing it was her, through the door and then firing 4 shots into that tiny space it was chilling. It made ME want to vomit.

So... Just a couple major contradictions in Oscar’s story so far that I have noticed that are critical and confirm his guilt for me.


I am using his actual statements assuming what was posted was accurate.

“After Reeva finished her yoga exercises she got into bed and we both fell asleep."
AND NOW….
“I woke up and she was still awake”

2nd was when exactly he first heard a noise and what the noise was


I woke up, went onto the balcony to bring the fan in and closed the sliding doors, the blinds and the curtains. I heard a noise in the bathroom and realized that someone was in the bathroom.
AND NOW….
“It was at this point that I heard a window open in the bathroom, it sounded like the window sliding open. I could hear it hit the frame as though it had hit a point where it couldn't slide any more. That's the moment that everything changed. I thought there was a burglar entering my home”

3rd was if the door was already closed or slammed closed
"I noticed that the bathroom window was open. I realized that the intruder/s was/were in the toilet because the toilet door was closed and I did not see anyone in the bathroom. I heard movement inside the toilet. The toilet is inside the bathroom and has a separate door.
AND NOW…
I heard a toilet door slam, what could only have been the toilet door. I couldn't see inside, but it confirmed for me there was a person or people inside.

I can see exactly where the defense is going with their story and the tweaks to OP's testimony.

It's a total lie, as proven by the independent witnesses hearing the arguing, the blood evidence, and the height of the bullet holes in the door, etc...but, I expect the defense to argue in closing that when OP got up to bring in the fans, Reeva got up to go to the bathroom. OP didn't hear her get up because of the fans, but he heard the window as Reeva opened it on her way to the toilet. Oscar grabbed his gun and yelled for her to get down and call the police, and hearing this Reeva ran into the toilet, slammed the door, and locked it, believing that OP had encountered an intruder on the balcony. Reeva didn't respond back to OP because she believed she was hiding from an intruder. OP shot through the door killing Reeve, believing she was an intruder.

(This still leaves a lot questions, like why he didn't see she wasn't in bed, why she took her phone to the bathroom at 3am, why the bloody cricket bat, etc.)

I hope he doesn't get off. It's clear he murdered her in a cold blooded rage. Does anyone have an opinion on what to expect from the courts in South Africa? Are they known for acquittals based on status, or influence?

So Oscar was either awake or woke up (he has contradicted himself here). Reeva was in bed looking at her phone. It was light enough to be able to go get the fans, and he could see jeans on the floor, but when Reeva got out of the bed, it was so dark that he couldn't see her get out of bed? Curious.

He admits Reeva was awake and talking, so why was his first thought that it was an intruder in the bedroom? Didn't he keep his gun on Reeva's side?

What I think could have happened is that he became enraged over whatever Reeva was doing on her phone (texting/emailing/chatting w/ someone he was not happy about?), and they fought. She ran into the bathroom to hide, perhaps attempted to open the window to escape, and he went for the gun so she hid in the toilet room.

I think her cell phone is incredibly sensitive to OP, since the first thing he did after breaking down the door was take her phone out of the toilet and attempt to unlock it.

Here is a lil bit on both the prosecutor and judge. You never know… but I think this was just about the worst combination Oscar could get to pull off this joke of a story… I am sure there is more about each of them, but these are things that I had read that really made me think that this was not a pair that would allow someone to just get off easy.





Prosecutor

He led the prosecution against Jackie Selebi, who was the national commissioner of the South African Police Service.

During the Selebi trial, he was arrested at his home in the early hours of 8 January 2008, in what appeared to be a bid to disrupt the investigation against the former top cop

Gerrie Nel has earned the respect of prosecutors worldwide. After the Selebi trial he received an award for "fierce pursuit of the vision of the National Prosecuting Authority's ideals to achieve justice in society" from the International Association of Prosecutors (IAP), a non-governmental and non-political organisation established to fight the growth of transnational crime.



Judge:

Masipa is only the second black woman ever appointed to the bench in South Africa and she has a reputation for tough rulings. The former social worker and crime reporter came to law late in life, graduating law school in her mid-40s. But just seven years later, she was appointed a judge of the High Court of South Africa.

Since then, she has made a number of headline-grabbing decisions, says TSN legal analyst Eric Macramalla.

Good point Theresa...I had not made that connection. I have thought his remorse was part of his "defense" but even more so now.

I just hope she's as smart as I think. And that his in ability to keep his story straight will prove he is lying.

I'm glad to see the judge comes down hard on violence against women.

Also Theresa, good point on OP's over the top display of 'remorse'. I'm shocked by the number of adjournments, and delays that have resulted from his wailing, vomiting and theatrics. His over the top emotion is off-putting to me. I'm used to the U.S. legal system where order and composure is expected.

It's almost like OP is in charge of the pace of the trial...when he faces a tough question, he just dissolves into a sniveling pile, and they adjourn for lunch or the day.

I'm glad that Pros. Nel called him out on it, and asked him why he's getting emotional now, and redirects the question as many times as he must to get the answer.

If OP is acquitted the judge has the option to find him guilty of the lesser charge of a SA version of manslaughter.

Mr Pistoruis has not been asked to plead on this charge but his statement that he did not mean to pull the trigger would imply a not-guilty plea.

On this charge, the judge will need to assign a degree of negligence. The higher the negligence, the longer the prison term. If convicted on this charge, he could face up to 15 years."

I'm sure it's been said numerous times, but I can't remember. Not to be judgmental, but she definitely lookes aged.

I was wondering if she turning on Sidney, but then someone mentioned that it could show that she's known. That makes sense. I don't think sheet pregnant.

When one is pregnant and over 40, there can be complications with the pregnancy. Not sure that particular jail is set up for pregnant inmates or a high risk pregnancy. I would think if someone were a Christian, they would be concerned about the health of an unborn child. That is if they are Christian. So far I have seen a lot of people saying they are Christians when in reality they are hateful racists. It'll be very sad to hear the hate spewed at this unborn child and its mother. No one is rolling on anyone. JM
