Amanda Knox's former lover Raffaele Sollecito claims that he does not remember whether she was with him at the time of Meredith Kercher's murder, bombshell court papers reveal.
In a dramatic change in legal strategy, Sollecito has cast serious doubt on Foxy Knoxy's alibi, with the Italian now saying he can't be sure she was at his house for the whole of the night on which the British student was brutally murdered.
All the evidence against the former couple points to Knox, Sollecito claims in papers filed by his lawyers in advance of a make-or-break Supreme Court hearing on Wednesday.
In their previous two trials, Knox maintained that they were together at Sollecito's flat on the night of the murder after which Miss Kercher, 21, was found half-naked with her throat slit in the cottage she shared with Knox in Perugia, Italy.

Sollecito, 30, and Knox, 27, served four years for their alleged part in the killing of Meredith before being released on appeal in 2011.
But in January last year their original conviction was reinstated and they were sentenced to 25 and 28 years respectively, a decision they are appealing.

Since then Sollecito has deserted Knox, his one-time lover, and is now insisting that their positions are 'not intertwined'. His case should have been considered independently of Knox's, he now insists.
Last summer he told a press conference that there were 'anomalies' in Knox's story and claimed that a text message she received on the path between their houses proved that she lied to him about her whereabouts.
And now the Italian has seemingly abandoned all loyalty to his former lover.

In an A-Z of reasons for distancing his position from hers, Sollecito's lawyers are attempting to demonstrate that the evidence used against Knox does not concern him.

In the 306-page paper, Sollecito claims that his computer records prove he was watching the Japanese Manga cartoon Naruto at the time of the alleged murder, but he is not sure whether Knox was at his house for the whole night as he had been smoking marijuana.
The document says: 'The defence intends to emphasise that Sollecito has always shown himself to be extraneous to the crime, and has always said that that night he did not move from his own home. However, he did not rule out that Knox could have gone out.'
The document also points out that Knox, unlike Sollecito, had an alleged motive for the murder.

The report explaining the motivation refers to a statement that Rudy Guede made to police that Miss Kercher believed Knox stole €300 and two credits cards from her.
Ivory Coast-born Guede is serving a 16-year jail sentence for his involvement in Kercher's death after a separate trial. Judges ruled he did not act alone.
Sollecito, by contrast with Knox, 'had no reason to want the death of Meredith Kercher.'
The document states: 'The alleged motives [not getting along and the missing €300] concern only relations between the victim and Amanda Knox, not Sollecito.'
At the time of the murder the young couple had known each other for only 10 days, and the document asserts that because this connection was so new they clearly did not have the kind of relationship that would have caused him to commit a crime on her behalf. 
'Raffaele Sollecito was not linked to Amanda Knox from long, deep emotional bonds that could have caused him to give his full and unconditional adhesion to a criminal act desired by others,' it states.
Knox alone demonstrated 'odd behaviour' after the murder, the paper points out, taking a shower at her apartment despite there being several bloodstains in the bathroom.

The court found it 'abnormal' that she returned to his house calmly and made breakfast before making the first phone call to her other flatmates, mentioning the blood and the open door casually.
The paper states: 'The defence believes these considerations are without any weight, since human reactions are entirely subjective, but they relate only to the female defendant.
'All Amanda's behaviour after reentering the house alone on 2nd November, which according to the verdict was abnormal, cannot refer to or be extended to Sollecito.'
Furthermore it was Knox who was solely responsible for the wrongful accusation of an innocent man.
After a long night of interrogation Knox allegedly confessed that she was at the address in Via della Pergola with her boss, nightclub manager Patrick Lumumba, on the night of the murder and accused him of killing Miss Kercher. She did not claim that Sollecito was there.
This false accusation was critical in increasing the suspicions of police and later added years to her sentence. She later said she was confused and retracted this statement.
The document acknowledges that that was likely to be a false confession. But, it says, 'if these statements are regarded as a genuine confession, they constitute yet another proof of the extraneousness of Sollecito to the crime.'

Continuing to build the evidence against Knox - and not Sollecito - the document reminds the court that Knox's DNA was found mixed with Miss Kercher's in the bathroom.
There has never been any mixed traces of Miss Kercher's and Sollecito's DNA found, the paper states.
The legal turnaround 'should not be read as an indictment of Knox', Sollecito claims in the documents. He said he has always declared it 'implausible to believe that the American could have taken part in such a heinous crime,' 
However most of the evidence points at her, and has damaged him by association, he asserts in the papers.
The document states: 'In these proceedings Amanda Knox and Raffaele Sollecito have been considered, wrongly, as an inseparable entity. This distorted image has certainly impaired the proceedings from the first trial.'
The paper, signed by Sollecito, said that his case should be treated independently of Knox's and asked the court for his conviction to be annulled on the basis that their cases should have been separated.
Markus Wiget, an Italian criminal trial lawyer and expert in extradition cases, said that Sollecito appeared to be throwing Knox 'to the wolves' in a 'brutal' last ditch attempt to save his own skin.

'It appears to be a very tough approach. You could say he is throwing her to the wolves. It is bad for Amanda' s defence but it might not be good for Raffaele's defence either. The lawyers are probably trying this approach as a very last resort.'
It is possible that Sollecito's conviction could be annulled and Knox's be confirmed, he said.
'The aim is likely to be to show that the conviction is illogical. By indicating differences in their positions Sollecito's lawyers stress the fact that the motivations that apply to one do not necessarily apply to the other.'
The deposition of the papers follows reports that Knox, from Seattle, Washington state, is to marry her boyfriend musician Colin Sutherland.
Sollecito tried to persuade Knox to marry him to give him the same legal protection that she enjoys from American citizenship, according to Radar Online.
But after she reportedly refused to help, he has found love with Italian air hostess Greta Menegaldo.
Sollecito claims he only learnt of Knox's imminent wedding from press reports which shows how distant they have become, the document says.
'The two were not captivated by a long term sentimental bond... [at the time of the murder] they had just met and had recently began a romantic relationship that, as events have shown, was not particularly significant. 
'After the arrest and even more, since their release, the two have become so estranged that it is only from press reports that we learnt that Knox is engaged to be married.'

If convicted, Knox could face immediate extradition proceedings and her supporters fear the worst.
One supporter told MailOnline they were prepared for what would be the 'greatest miscarriage of justice' that has ever happened to a US citizen.
Dr Mark Waterbury, who lives close to the family in Seattle, says: 'The people I communicate with, who are close to the case, are very concerned about the result.
'It's my understanding that people who are working with the family believe that the ruling will come from facts based on the 'judicial truth' from Rudy's trial where they said there must have been multiple attackers. This fact can't be contested.
'This is like someone down your street being tried for a crime, but they decide to convict you afterwards because that person claimed you were involved and you can't even defend yourself.
'It makes no sense and just wouldn't happen in the UK or US. It is truly astounding. One more round to go in this crazy justice system. I don't have a good feeling about this.
'There have been bizarre facts, research that makes no sense, and witnesses that have been dug up from the gutter.'
Meanwhile, the Kercher family are not planning to be in court on Wednesday but they hope that the Italian government will be swift in requesting extradition if Knox is convicted.
Family lawyer Francesco Maresca said: 'The interest of the family is to arrive to the end of this trial. They want to be able to remember Meredith outside of the court room.'

Love-lorn male commentators, start your engines!

Even after all these years and lots and lots of analysis showing that Amanda Knox was, in the very least, in possession of guilty knowledge of the death of her roommate and was deceptive, and likely present for the death (though did not inflict the fatal blow), we still spend considerable time deleting comments from male defenders. The comments do not ofter rebuttal for analysis, nor present contrary analysis.
They offer insults.

As Knox ages, will they continue this, or will the obsession wane with time?

Very interesting. And he really has a point.

I also think since Ananda admits she had sexual relations within that night, she could have transferred his DNA to the bra. And she could have taken his knife then brought it back the next day.

I wish we had more statements from him to analyze.

I hope they lock up Raffi right away. while she stays ahead of a long extradition process, then he'll really turn on Knox. extradition or not -- more story will come out,

I like how Raffi's lawyers insinuate if the two had been dating longer then Raffi might have killed for her. haha. -- brisng to mind how they described their relationship - from the start as being like lightening - instant deep connection etc,

I am surprised how many Americans are claiming she is facing/faced double jeopardy.
They don't get that in Italy there are 3 courts each verdict goes through before it is validated, with both sides able to appeal each court.

This is all one trial, the second verdict in the middle court, found them not guilty however the prosecutors appealed and the verdict was annulled, meaning it never existed.
The verdict after the appeal in the middle court was guilty , making them both found guilty in both courts.
The final appeal in the supreme court is not on their guilt or innocence, that is already decided and cannot be changed, it is appealing on points of law, technicalities and loopholes which the defence will use to claim innocence for their client, to minimise the role of their client whilst throwing the other under the bus.
At best they will aim for a reduced sentence perhaps even time served (4 years)

Knox's parents have problems financially since they paid for her defence as well as facing slander charges of their own for repeating the fake assault claim against LE.

I await with interest to see if the publishers will demand their money back since they paid out for her claiming innocent and found innocent during the 2nd appeal (which was annulled) Since she lied, can they claim a refund?
if so how will she pay since the money was used to(i assume) repay her parents for the cost of her defence as well as other stuff.
If the money is gone will they sue her for the money they spent on her defence and PR and will she sue her parents so she can pay the money back( would this be fraud since she lied?)

Will she be extradited?
I would hope so since she is a convicted murderer and not even obama is that dumb to refuse a request, especially if he want the treaty to apply when he wants an American extradited from Italy as well as all the trade agreements and other countries who have extradition treaties with the States.
Is a convicted murderer more important than all the treaties?
Will the Italians allow for her to serve her full sentence in the States so her parents can visit?
If so, she would have to serve the full sentence and not a couple of month or years and then parole and probation.

If you freely go to a foreign country, then you are bound by their laws. I'm sick of hearing how it would have been handled in the US.
If she if found guilty, she should be extradited and the US should turn her over, just like if the crime happened here and the accused was in another country.
Also, I think she is guilty.

I am still not clear if I think Raf was involved or not. And his language I think makes it harder to use SA with many things he has said… But, I just looked at the transcripts for his interview with Katie Couric and one thing stood out.


Couric: What would you say to a significant number of people who do still believe that you and Amanda were involved in the murder of Meredith Kercher what would you say to them?

Sollecito: Well, um, I'm pretty sure that they just followed the case by the media. The media frenzy created just a figure that is, is, it doesn't exist. So they created a story to brought just to keep the audience, to keep the audience and make money. They just accepted what the prosecution brought to them. But all the details, they spread around were, were without any circumstance around. They were disconnected to each other and they created a fog of nonsense. So I wrote a book and just to have the opportunity to talk about me to, to keep the figure of me..


I get that he struggles with English. So…. I would expect shorter responses. And if someone asked me what I would say to those that think I was involved, like Peter always asks… I would say “I want them to know that I did not kill Meredith”
Instead he has this long paragraph…..But never actually says or denies anything.

The other thing that bothers me is the "I don't remember" stance.

If that's the case, that's clear. We were high and I don't recall what happened after 8pm or whatever time.

But assuming the were only smoking pot like they said..that's not going to put you in a murderous rage. I tried pot a few times when I was younger and it made me hungry and lazy.

I just think that's something so clear. They have both even struggled to just clearly state " I don't remember".

I don't think we will ever know what really happened.

When given the opportunity, sollecito rambled and waffled rather than state I did not kill Meredith Kercher.
Italy's high court has delayed its decision on Amanda Knox and Raffaele Sollecito's appeal against their convictions for the murder of British student Meredith Kercher.

Ms Kercher, a 21-year-old from Coulsdon, Surrey, was sexually assaulted and stabbed to death in Perugia in 2007.

Her flatmate Knox, a student from Seattle in the US, and Knox's then-boyfriend Sollecito spent four years in jail for the murder but were acquitted on appeal in 2011.

Knox returned to the US before an appeal court threw out the acquittal and reinstated her and Sollecito's guilty verdicts last year.

Italy's Supreme Court is due to decide whether to uphold those convictions, which would put an end to eight years of courtroom twists and turns, or order another appeal.

The verdict - which could spark a request for Knox's extradition from the US - had initially been expected by the end of the day.

But court president Gennaro Marasca said a ruling would not come until Friday to allow the prosecution and defence enough time to present their arguments.

Knox, who is now 27, will not appear in court to see if her 28-year sentence is confirmed.

Sollecito, 30, has had his travel documents seized and is attending the hearing. He was sentenced to 25 years.

The Kercher family, who are not in court, have said they would like to see Knox extradited to Italy if her conviction is confirmed.

The family's lawyer Francesco Maresca said earlier this week: "The interest of the family is to arrive to the end of this trial. They want to be able to remember Meredith outside of the court room."

Ms Kercher's brother Lyle told Sky's Senior News Correspondent David Bowden he does not understand why at least one of her killers is not in jail.

He said: "I don't understand why Sollecito is not in custody at present," but speaking about Knox he added: " I understand why she doesn't want to come back."

Mr Kercher said if the Americans do not send her back to Italy to face justice it "makes a mockery" of international agreements.

"I can't see how the US wouldn't be able to co-operate" and "it will compromise US authority to extradite people from other countries in future", he said.

Knox said last year she would become a "fugitive" if convicted and would have to be taken back "kicking and screaming" to Italy.

If the court backs her conviction, Italian legal experts have said she could delay going to jail if she were pregnant.

Last month, she revealed her engagement to 27-year-old musician and school friend Colin Sutherland, who wrote to her while she was in jail.

There has also been speculation that political pressure from the US could hamper the extradition process.

Sollecito is reportedly seeking to separate his case from Knox's, with his lawyers pointing out that a partial confession written by the American and later retracted did not mention his presence at the scene of the crime.

If that argument succeeds, the Italian could be given a new trial.

I wonder if sollecito has tried to come to some kind of deal with prosecutors?
Perhaps admitting his role to a degree and throwing knox under the bus.

Since he is stuck in Italy, he will go straight to jail whereas knox is free in the States and can delay and fight extradition or if all else fails maybe try and do a deal to serve her sentence in the States.

He is not going to be happy sitting in jail whilst she is free in the States, one down all down.

It would not surprise me if knox instigated the whole thing in the first place.
Sollecito barely knew her, he won't be happy that she has ruined his life t such a degree (even though he was involved it likely would not have happened if he hadn't met knox)
his family will be telling him to tell the truth, tell the court what happened and her role so she faces justice as well.

Knox has had to admit she was present at the rape and murder since sollecito dropped her in it by saying he couldn't vouch for her the whole night.
This then makes her original handwritten statement correct (even though she minimised her role)
So much for the forced confession so beloved of her supporters.

I can't wait till friday to hear the verdict and find out what sollecito's defence is doing and has done.

I also wonder if know will then be sued for return of all money paid to her on the basis she claimed she was innocent and on the basis of the now annulled not guilty verdict (meaning it never existed and that both have been found guilty twice)

One statement Rudy made (I was a written letter)

When asked why he wrote that, he said this:

And I found some testimony from court that has been translated. So being translated, not sure how well we can analyze the actual words.

The thing that stands out to me is that he is not just stating factually that Amanda and Raf did this directly. But that it’s a thought in his mind.

All 3 seem to lack any ability to just be straight forward.

I went out, but in the living room and kitchen there wasn't anyone, so I went toward Meredith's room. There was the back of this person inside the room and I said "Hey what’s happening?" Then I immediately saw Meredith's body on the floor and I also saw blood, and I said "What the f**k have you done?" I yelled, and the person turned around. He was a male, he was Italian because he insulted me and had no foreign accent. He had the knife in his hand and he tried to get me. I tried to shield myself with my hand but it was a sharp knife. Only brushing against me, it made small but deep cuts. Like a scalpel, it only needs to brush against you and it cuts. I hadn't zipped up my pants and while backing off I fell. He tried to attack me but I took a chair to protect myself, being stronger than him. Although I had a chair and he had a weapon, he exited through the front door telling me "black man found, guilty man found," he yelled.
I got up and went to Meredith's room. She was all covered with blood. Her neck looked like a river, she was asking for help. I kneeled next to her and tried to close the wound, I never saw so much blood. I went to the bathroom, took a towel, and it was soaked. I took another one, but darn, nothing. So much blood was flowing that the wound wasn't even visible. I asked her what had happened and she was repeating that sound "AF, AF, AF." I tried to write somewhere. Since my hands were all covered with blood, I tried to write on the wall. It was the fastest way, I thought. She was holding my hand. She didn't want to die, but I wasn’t able to save Meredith. I didn't have a phone…

After those words (NDT: black man found... etc) I was scared. I was covered with blood. Who would ever believe me? She told me not to leave her alone. I knew it because she was wailing with her arms stretched out at me. But I was shocked. All that blood, only on TV and in horror movies, something like this had never happened to me before. Even now I can't sleep. I see that sweet face covered with blood.
Why did all this happen to her, why? If only I had been man enough I would have saved her. But I am not, and I’m ashamed of myself. I would want to be in her place and she'd still be alive. I could have saved her. I dreamed of saving the world and wasn't able to save one person. I have been selfish. I only thought of myself and for this reason I don't deserve to live. It’s not fair that I live and a sweet and scented flower like Meredith has been broken, while I breathe this air that she should be breathing. No, it's not fair. I hope Up There (NDT Rudy is referring to Heaven) She will forgive me one day because I believe I'll never make it Up There because of my cowardice. She will be a new star, a lost angel called Meredith.
I am asking myself how is it possible that Amanda could have slept in all that mess, and took a shower with all that blood in the bathroom and corridor? Why Patrick? Who was that person, Raffaele? And then "AF, AF." It could be his name. And then if thieves had been there, why isn't Amanda saying a word about the missing money? And who was in the house below when I left? What has ever happened between Amanda and Meredith?

No statements to analyze with this, but saw this and found it interesting… This was the first I had heard about this… With regards to the computers that were looked at.

Filomena Romanelli’s computer exhibited hard disk problems on the evening of November 2nd, when Romanelli was at the police station. This was before any of the police had analyzed Sollecito’s and Knox’s computers. (Gregori 2009)
Sollecito’s 2nd computer, Knox’s computer, Ms. Kercher’s computer all had hard disk problems, making data difficult to retrieve. (Trotta 2009)
Lumumba’s computer was analyzed at the same time as the other computers and had no issues. (Trotta 2009)
Weird that all the computers belonging to those involved had issues….
