Calum McSwiggan Statement Analyzed

 Calum McSwiggan claimed to be targeted for a "hate crime"  southern Hollywood.  

Here is his statement, his statement analyzed, and the findings of the investigation.  

I.  On instagram and face book, McSwiggan wrote:  

“Last night was the worst night of my life and I’m really struggling to find the words to talk about it.  After one of the most wonderful weekends at VidCon we went out to a gay club to celebrate, and towards the end of the evening I was separated from my friends and beaten up by three guys. 
“I’ve never felt so terrified to be a gay man in the public eye"

II.  The Analysis 

It is so that our statements reveal us:


“Last night was the worst night of my life and I’m really struggling to find the words to talk about it. 

Note the struggle is qualified with "really" as he posts it for the entire public to read. 


 After one of the most wonderful weekends at VidCon

where someone chooses to begin a statement is always important.  For him, it began with "really" struggling to find words, but this principle is also important to note where one begins the statement of an assault.

An assault is very 'unclose and personal' and the language will reveal this.  It is an invasion of personal space, and it is responded by extreme elevated hormones, impacting the victim and the victim's recall, later on.  

Here we note that he begins first with the struggle for words, which he qualified, but then he moved to the element of "time" in his statement.  

"After" what?  

One of the most wonderful weekends...

This is to address not only how "wonderful" this particular weekend was, but to do so in comparison to other wonderful weekends, of which this is only "one" of such.  

This is not something expected from a victim of a physical assault.  


 we went out to a gay club to celebrate,

Here the victim of an assault immediately moves from beginning his statement without the pronoun "I", ("last night") to the pronoun "I" used to describe a qualified verbal struggle, to "we" telling us:

a.  he was not alone
b.  what kind of club he went to
c.  why 'we' went to a club

This is a lot of information given to us before the assault and shows the priority of what was on his mind as he typed the statement. 

Consider experiential knowledge in recall will be accompanied by the hormonal increase that imprinted the event upon the brain.  We look for, and expect, evidence of such.  



 and towards the end of the evening

Instead of telling us of the assault, the lengthening of time is given, further delaying the "main event" of an assault. 

 I was separated from my friends 

Passive voice used:  "I was separated" avoids telling us the responsibility for how this separation took place and should, by itself, continue to cause the analyst pause as to the veracity of the statement.  



and beaten up by three guys. 


Note that he gave a lengthy delay, not only in the number of words or characters (letters) used, but in the quality of time passing.  He wants us to know, before he was assaulted:

1.  It was the worst night of his life
2.  He really struggles to find the words
3.  He had a wonderful weekend
4.  He has had a number of wonderful weekends 
5.  He considers social media his way of "talking" about it 
6.  He wants us to know where he went
7.  He wants us to know why he went there
8.  He tells us that he is thinking about what he did during this evening (another psychological delay) 
9.  He wants us to know he was with others
10.  Then he wants us to know that he was not with others, but conceals how this separation took place

Finally, using passivity, "was beaten up by three guys."

By its form, the analyst should see it as "unreliable."
By its form and language, the analyst should see it as deceptive.  

Then we have his 2nd reference to emotions; the first being the struggle to really find the words to talk, and now here, the words that follow being "beaten up" are his emotion.  This is the final clue that indicates deception:  the artificial placement of emotion:

Hopefully he will NEVER be addressing this fully in the future. The added shot to LE that they should have been there to protect him? What? Does he expect his own personal security detail?He actually broke 3 teeth and split his head open with a PHONE? Idiot. I wonder if he'll use SM to issue an apology. Idiot.

He mentions 3 friends.
"with me the whole way" With = distance. Where were they when he was attacked? He first stated he was separated from his friends.
Also, where is the right place to talk about it? Where was his location at the time of his social media posting, that would make that place not the "right place"
When else has he been terrified to be gay in public?
Physical assault is terrifying. How did he know he was being assaulted specifically for being gay?

My favorite part might be where he claims he regained consciousness, noticed his broken tooth and instantly starts vandalizing the car. He punctuates this with how he's been a champion for gay rights for his whole adult life, so he didn't take this "attack" lightly. No mention at all realizing the attackers were gone or checking to be sure they weren't just hanging around waiting for him to come to before he started beating up the car.

I think his "attack" was being rejected by a guy he was flirting with and he got even by vandalizing his car. I think he felt entitled to do that because, after all, he has been a life long advocate for gay rights.

if you watch his youtube videos, there is a great deal of story telling, all with blue flags all over the place. i would venture to say that he is exhibiting narcissism and borderline traits. it would be appropriate for his friends/family to suggest counselling. After the current run in with police and self-harming to falsely support his story, it is apparent that intervention is necessary at this point.

His "TRUTH" post is absolutely ridiculous. Why is he still talking?? What is wrong with him? He needs to run back to his own country before he gets thrown in jail here for filing a false police report and whatever else they can charge him with. At least the majority of people on his comments are calling him out.

Theresa, I like how his "true and full story" describes "In a moment of desperation to get out of the cell, I took the pay phone off the wall and hit myself once across the forehead with it as hard as I could." In his injury photo, you can see the imprint of the round edge of a telephone receiver across the right side of his lips and beneath his right nostril. I wonder if he managed to accidentally break his own tooth by hitting himself too hard. I suppose when you're drunk, it is difficult to beat yourself up with precision.

For what it's worth, when you're arrested, you are not entitled to call anyone you want ("to speak to a medical professional, a councillor, my parents, my friends, a lawyer, for a phone call, or to be transferred to a hospital") as soon as you want to. The jail personnel follow a rigid assembly-line process; in fact, the fingerprinting, mug shots, personal effects inventory, and other booking procedures are referred to as "being processed." Things happen on the jail's timeline and can take quite a while. After the jail personnel are finished with the processing, you are generally allowed to call whoever you like. These calls are collect calls at the expense of the recipient of the call, and they are recorded. They are often fertile ground for the prosecution to use as impeachment in the criminal case. Professionals like lawyers, bail bondsmen, etc. won't let you discuss your case with them while you are talking on the jail phone. Also, I strongly doubt his claim that the jail wouldn't let him call a lawyer specifically -- the West Hollywood jail in particular would know better than to do that, they are fully aware of defendants' legal rights in this regard -- although I acknowledge it is possible that they wouldn't let him interrupt the booking process to call a lawyer IMMEDIATELY.

Reading John McGowan's link, the obvious finally struck me: If the police put you in a jail cell with a pay phone, by definition you are not being denied your right to call a lawyer or anybody else.

I'm still trying to figure out why he was trying to get out of the cell. If he was such a helpless victim of violence, he wouldn't be in a jail cell in the first place. Last I checked, harming yourself to escape jail is "frowned upon" and carries heavier consequences.

If you look at the picture of him claiming he couldn't lift his arm higher that it was due to the pain, pay close attention to the position his left hand is in.

His left hand is thumbs down.

Now try it yourself. lift your left arm vertically from the side position with your thumb up.
You can do it easily.

Now try the same thing with your thumb pointing down.
You can only raise it so far before it becomes painful to raise any higher.
This is because of the way the ball and socket joint are situated in your shoulder.

He can't raise his arm any further and it will hurt because he rotated his hand to a position where such a movement is resticted.

Not many people would have noticed which way his hand was pointing, and this makes all the difference.

But this time an unarmed Hannah set off the metal detector at a security checkpoint.

Shirley said that she tried to tell TSA agents her daughter is deaf, blind in one eye, paralyzed and easily confused. But says she was kept a distance away by police. "She's trying to get away from them but in the next instant, one of them had her down on the ground and hit her head on the floor and I looked and there was blood everywhere."

Hannah was arrested, booked and on the night she should have been celebrating the end of her treatment she was locked up. 
"Here we were with nowhere to go, not even a toothbrush, our bags had already gone to Chattanooga," Hannah’s mother said.

Authorities later threw out the charges. But the family filed a lawsuit against the Memphis Airport, airport police and TSA.
None of them would comment citing the suit, but TSA did say "passengers can call ahead of time to learn more about the screening process for their particular needs or medical situation."

Starting the sentence with the preposition, "with" is distancing. It does sound like the broken teeth and six stitches came after the attack because they are not attached to him. i.e., triage would say "patient presented with three broken teeth and cut". The subject makes them sound like they're not part of him, like it's something he has, something he brought a long. They are out of place.

After this I was talking to them, I don't remember about what specifically, but at some point in that conversation his tone and attitude flipped. He said something about my friend Melanie and then punched me in the mouth. I blacked out quickly after this but remember being kicked in the body multiple times, I believe by all three men.
Shortly afterwards I regained consciousness and instantly realised one of my front teeth was broken.

If i have this right.

It is when a sentence "begins" with the word "and" that it indicates missing information between the sentence and the one that preceded it, as it is used as a connecting word. "I went the shops "and" bought some groceries" The shops are connected to buying groceries. Whereas, if i said "I went to the shops and some bought groceries". "And" went home" it is a jump in time, (similar to saying and "then") hence missing information.

I really think this father is being deceptive and knows more about what happend with the little girl
Tho police has rulled him out as a suspect but his wifes nephew is been piont out, because of leaving town days after the girl wet missing....tho i believe both men or at least the father knows more then he says. (the nephew didnt want to speak)
Tho the reaction of this father in iterview is very disturbing.....from telling with dry eyes how his girl went missing and how he found out....then saying sorry a dozen times, ,crying his balls out...and keep saying "sorry for not being their to protect you, i should have been the one to have protect you and..." big red flags for deception if you ask me.

Yes, I see what you are saying.

Looking at the sentence by itself and playing it out, like a movie, in your mind's eye:

I began flirting with him and left The Abbey with him.

Does it appear spliced to you? It does me. i.e., a scene starts but fades to a completely different scene. It makes me wonder, what happened after he began flirting with him? Did the alleged attacker tell him to buzz off? Did he turn his back on him or move away from him? Did he continue to make a nuisance of himself? The situation started (began) but there is not middle or end between CM and his alleged attacker, in the bar. The alleged attacker, who was accompanied by two friends, seem to have left rather quickly to CM (just) beginning to flirt. He doesn't even have himself leaving "with" him, making leaving along with his alleged attacker and company weak.

A North Carolina mother whose 9-month-old son died when she accidentally left him in a hot car will not face charges, prosecutors have revealed.

Nancy Byrd-Wilkins discovered her son Jefferson Wilkins was still inside the car when she went to his daycare to pick him up - and found out she had never dropped him off that day.

New Hanover County District Attorney Ben David said Jefferson's death was an accident that came from the 'perfect storm' of a change of routine, sleep deprivation and 'outright forgetfulness'.

Byrd-Wilkins had first woken up with her baby at 3.30am that fateful morning on May 25 before going back to sleep.

She then had to take him to an early doctor's appointment that morning and her husband, Jeremy Wilkins, dropped off the couple's four-year-old son at the Pax Natura daycare.

After the doctor's appointment Byrd-Wilkins headed to her regular Starbucks drive-through coffee shop, where she goes every morning. And that's when she slipped into her daily routine.

Instead of dropping off Jefferson at Pax Natura to join his brother, Byrd-Wilkins headed directly to work. She clocked in at the Ivy Cottage, a consignment shop in Wilmington, at 9.36am.

Jefferson was left in his mother's black SUV for eight hours. Temperatures that day reached 86 degrees F, according to the Wilmington Star News.

The internal temperature of a vehicle can rise 19 degrees within the first 10 minutes and 34 degrees within just half an hour, according to experts.

Byrd-Wilkins clocked out at 5.17pm and drove 2.2 miles to the Pax Natura daycare center. When daycare workers told her they didn't have her baby, she at first thought he'd been kidnapped.

'She then ran out to her car and discovered that the child was still in the vehicle,' David said.

What followed was a horrific and tragic scene. Nearby bystanders tried to help, breaking the back window of the SUV so they could open the door and retrieve Jefferson's lifeless body.

A daycare worker, who like Byrd-Wilkins had called 911, tried to perform CPR. When she realized it was hopeless, she began to cry with Jefferson's mother.

David said it was a scene that brought 'even hardened career professionals to tears'.

Jefferson's cause of death was hyperthermia due to environment exposure/accident.

David said the investigation included analyses of Byrd-Wilkins' cell phone and surveillance videos, blood tests that ruled she was not under the influence of drugs or alcohol, and interviews with coworkers and witnesses.

'An innocent baby is dead,' David said.

'Filing criminal charges will not make us safer, balm our hurt or bring him back. We should not elevate a tragedy to a crime merely to say that grave accidents cannot happen and must be the result of something more sinister.'

'Sometimes accidents do happen, and they break our hearts.'

I don't buy this story.
The car would have been stinking and she didn't notice this?

She didn't notice her child strapped in his car seat when she approached the car and then got into it?

When you get in your vehicle, as you approach do you look only at the driver's seat as you approach or do you glance around including into the back seat?
I know when i get into my brother's car (i don't drive)i instinctively look in the back seat and front seats as i approach and get in.
When leaving the vehicle i also do an instinctive check to make i have left nothing behind/visibly tempting to a criminal.
Was she wearing blinkers?

There is simply no way in hell that she didn't see her son in his car seat, no way in hell that she didn't smell anything in the car.
The poor boy would have sweated buckets, he would have soiled himself.
The car would have been stinking.

I also don't get why nearby bystanders tried to help by breaking the back window to retrieve him and perform CPR.
She had the keys why did she not just unlock the doors had they been locked?
What did she say and do when she 'found' her son strapped in his car seat?

This smacks of justin ross harris and his child in a hot car upcoming trial.

I read an article a year or so ago about deaths of infants forgotten in carseats. This is a thing that is happening every year, ever since they introduced the rear-facing carseats that are placed in the back seat of the car. Yes, it is a safer way for babies to travel but it puts them in danger in a different way. Busy parents who are used to a certain routine and babies who fall asleep on the ride and are quiet and out of sight combine to create this horrific tragedy. It almost always involves a change in routine, where the parent who doesn't usually drop the baby off is supposed to on this one day. The baby falls asleep and is quiet, and the parent slips into their normal, unthinking routine and completely forgets.

Something needs to be done, some kind of carseat alarm or something. Parents need to get into the habit of always visually checking the carseat before leaving the car, even if they know they don't have the baby that day. I am a forgetful person by nature and I cannot imagine the horror it would be to realize you had forgotten your infant in the car. It would be the worst nightmare.

I noticed the article said the coworker who tried to do CPR, when it proved hopeless, she "began to cry with Jefferson's mother" so maybe the bystanders broke the window because the mother, upon seeing her infant still in the car, became hysterical and was unable to function.

I do think there are people who purposely leave their baby to die in a hot car- hopefully those kind of people are rare.

I am a mom of a 17 month old boy.....but i cant imagine that i would forget him at my car....first of all i bought myself a babymirror (only 10euros or smt) so i can watch him while driving and he can see me (this also works for those carseats that are facing backwards) but ok lets say i didnt have that.....i could imagine that in the morning you maybe fortget your kid because of changing routine (although i find it hard to believe....but lets asume for this that could happen).......i would never believe when you come back from your work....step into your car and you drive to the daycare...to step out again and find out at daycare the kid was never left there.....and all that time you not once have seen your kid in the back of your car........sorry but i find this to hard to believe.....i feel its just an excuse for a mistake thats been made the first time (when going to work and forget the kid) but its no excuse for the secnd time (done work back to car drive to daycare)......i just cant believe the person not noticing anything during this time......if thats really the case...then this person should never be left with kids alone ever again
