Affidavit Claims Kidnapping To Be Hero of Nichole Cable

from Bangornews.com:

A 15-year-old girl’s death was a kidnapping gone wrong, according to the affidavit released late Wednesday after the Penobscot County grand jury indicted Kyle Dube, 20, of Orono on charges of murder and kidnapping.
Kyle Dube was charged on May 21 in connection with the death of Nichole Cable of Alton and Glenburn on Mother’s Day, the day she disappeared. Her body was found late May 20 in a wooded area of Old Town.
Dube intended to “kidnap Nichole and hide her; that he would later find her and be the hero,” the affidavit, written by Maine State Police Detective Thomas D. Pickering, said.
Dube’s brother Dustin Dube told police that Kyle Dube said he had Cable “meet him down the road [from her house]; that he waited in the woods wearing a ski mask; that he had duct tape; that he jumped out of the bushes and took Nichole; that he duct taped her; that he put Nichole in his father’s pickup truck; that when he removed Nichole from the truck she was dead; that he dumped Nichole’s body in the woods near the Dysart’s gas station in Old Town; that Nichole is in the woods covered in sticks.”
Kyle Dube’s girlfriend told police that he had told her a similar story and also said he had thrown Cable’s clothes out the window of the truck on his way back, the affidavit said.
When interviewed by an investigator on May 15, Kyle Dube said he had a relationship with Cable but was working in Bangor the night of May 12. He said that he had texted her earlier in the day, the affidavit said.
Kyle Dube created a fake Facebook page using the name Bryan Butterfield of Bangor to communicate with Cable, according to the affidavit. Investigators learned of the page from the real Butterfield on May 14 after one of Cable’s friends said the 15-year-old had sent her a text on May 12 stating she was meeting “Butterfield.”
Butterfield told investigators that he suspected Dube had created “this fraudulent Facebook account; that he knew that Kyle wanted to have sex with Nichole, but that she has refused his advances,” the affidavit said.
The document does not explain how Butterfield knew Dube or Cable.
In reviewing Cable’s Facebook account, investigators learned that she had frequent contact online with the fake Butterfield.
“The person posing as Butterfield repeatedly requested to meet with Cable in person,” the affidavit said. “On May 12, Cable agreed to meet with this subject for the purposes of obtaining some marijuana.”
According to their Facebook communication, Cable was to have met the fake Butterfield at the end of her driveway, located in a remote section of Glenburn on a dirt road.
Investigators traced the IP address for the fake Butterfield’s Facebook page to the Orono home where Dube lived with his parents, the affidavit said.
Investigators also were able to link Cable to Dube through DNA evidence, according to the affidavit. A blue hat with a hole cut in it, a sock and black sneaker were found on May 14 in a wooded area near Cable’s mother’s home in Glenburn. Dube’s DNA, obtained May 15, was found on the blue hat and on the sock. Cable’s DNA also was found on the sock. Whose DNA was found on the shoe is not stated in the affidavit.
Cable was reported missing to the Penobscot County Sheriff’s Office by her mother, Kristine Wiley, at 8:27 a.m. May 13, the affidavit said.
Dube is being held without bail at the Penobscot County Jail. An arraignment date has not been set.
Deputy Attorney William Stokes said shortly before Dube was indicted that the medical examiner had ruled Cable’s death a homicide. He said exactly how the girl died could not be determined until tests are completed by the Maine State Police Crime Lab.
Cable’s funeral service drew about 300 people Monday at Bangor Baptist Church. Her private burial was held Tuesday at a cemetery in Alton.
If convicted of murder, Dube faces between 25 years and life in prison.

I think the story in the affidavit is completely bogus!!!

There is way more to it & only time will tell what the truth is.

Wow what a sick idea, what is wrong with this guy?

Did he really think they would not find out he was the kiddnapper?

A very tragic thing to happen to a a daughter; and mother, and of all times, on mothers' day. Then learns her sneaky daughter is picking up boys off the internet for pot. Somehow, nearly everything that goes bad in our childrens' lives got its' origins initially with pot smoking.

I guess they've all got a backache and need some 'goofy' pain meds? Poor Clint, probably got his backache with a slipped disc from riding the mechanical bull at a bar while high on pot.

Seriously, not making light of Nicholes' horrible murder; it really is horrible and tragic.

I can't believe he told his brother and "girlfriend" all that info. There seems to be a large gap in the story. One minute he's kidnapping her, next he finds her in the truck dead.

I agree, Peter, you should take that down. Perhaps you'd move faster on this if it was your own child being targeted.

Miss Williams, 17, has not been seen since Sunday evening. Her friend, 22-year-old Jamie Reynolds has been arrested on suspicion of her murder.

Well at least she told someone. she was probably terrified and didn't know what to believe or what to do. As adults we see such a bigger picture than adolescents/teenagers do. For instance when I was a teenager I often went fishing with my boyfriend at the time. One day we reeled in what appeared to be chunks of human hair, after getting the line caught in a snag. In fact it happened twice that day. We never called police or realized that there could actually be a human body down there. We thought to ourselves, wow that is freaky there is probably a body in here! but it didn't occur to us that something should be done about it. Now I look back and realize there's a good chance it could have been!

THere is a LOT missing in this story. At what point did he remove the clothes? If she was sexually assaulted, when did he do that?
No matter how you look at it, he killed her and his motives were always wrong. If there is any truth at all to his claim that he wanted to be the hero in the end, he sure chose a strange way to do it. There are a gazillion other ways to be "a hero" or even a person who is doing good for society. He could have found ways to do good things if he wanted to seem good to others. I wonder what lurks behind that motive too - meaning that he doesn't feel capable of actually being a good guy but he sort of wants to. It sounds like he is experiencing a huge battle between good and evil - obviously the evil side won this time.

If the police traced the fake Butterfield IP to Dube's parents' home, why wasn't he arrested on day one? If his girlfriend had inside info and never shared it to help Nichole, why isn't she in jail?

Lis said...

It's hard to understand how he thought he could overpower Nichole, bind her, take her to another location and hide her, without her ever figuring out who he was. It was reported by her friend that she'd been seeing him, so I think the idea he could do all this without her realizing who he was is hard to imagine.

The other thing that strikes me is how cruel this was to Nichole. She was just a prop to him, not a human being. The terror she must have experienced and the destruction of her sense of trust were nothing to him. According to the story, he duct-taped her and threw her in the back of the pick-up truck. She would have had no way to protect herself from being bounced around and injured.

The comment from Bryan Butterfield is that he suspected Dube as soon as the false facebook account was made and he told authorities this, and that it was because he knew Dube wanted to have sex with Nichole. So I kind of think there is more to Dube's story than what he has confessed to.

Lis said...

Yes, he told his girlfriend and according to people who know her, she was speaking ill of Nichole after she knew what had happened.

Nanna Francis, you are a regular poster on Peter's blog.
May I suggest you find out the order in which events occurred, as it does explain much of your question.

Since SM was implicated in the affidavit, now public, she was placed in a facility where more was learned.
Beyond that information, I am not comfortable about sharing.

What a story,(the accidental death part) probably just to try to get lesser charge.
Sounds like he planned on hurting her for awhile.
I wonder how long the brother and girlfriend knew about it?

The affidavit is poorly written, missing dates etc. The state cops need better training! Hope this doesn't have legal ramifications in the prosecution.

Hmm ... out of curiosity, how would you rewrite the affidavit, and make it suitable, for the judge/court, grand jury, Nichole Cable, Kyle Dube, and your needs, based on what you do (or do not) know?

In all seriousness...WHAT? His "plan" had to have been something he hatched after Nichole died. WHO the heck does that? Kidnaps a girl with the intent to "find" her and be the hero? What in the world?

I'll bet his girlfriend (or hopefully, former girlfriend) feels lucky to still be kickin' after learning what a psycho this kid is!

I'm still so sorry for Nichole's family, and for the fate she met. Teenagers make stupid choices, it's true, but she ought to be alive grow up and help others not make those mistakes.

It makes me wonder if the recent story of the girls being held captive in ohio and found by the "hero" neighbor sparked this idea in this guy. Based on the limited information we have he sounds like a sociopath. another commenter pointed out that he had this urge to "appear" as a good guy.the hero..all the while doing the bad acts. there was another story on here about a guy with the same name leading police on a chase. i'm not sure if it's the same kyle.

I agree with Lis. I don't believe Peter is running this blog anymore. It seems different. Mostly someone just throws up articles then the commenters attack each other.

I hope you are alright, Peter. (And your family.)

PS Even in the articles that have so-called analysis, the words and tone seem different than Peter. Maybe I'm imagining things, though.

Lemon, you usually post productive comments.
Did I waste your time by posting my opinion regarding endangering a minor on the internet?

I do not recall having 'told' Peter to do, or not do anything.
Granted, this is HIS blog.
No argument.
This is the comment section, correct?
Perhaps I missed your point?

I will not pardon my attempts to suggest all adults make an attempt, to make the internet safer for minors, who, by law, are exactly that ... as in, under the supervision of one or more adults.

Since you, Lemon, brought up DM ...

Link, please.

Unless you wish to state who 'Lemon' really is.
Sorry you decided to try to make this a pissing contest, because, feel free to 'win' if that is the expectation you desired from your post.

I am not responsible for her current custodial issues.

3. Correction, I was trying to correct a minor male falsely linked via Peter to the 'real' person charged with murder, not the female in the affidavit
4. Wrong
Who is DeDe?

None of this makes sense. Wasn't Nichole raped? What about the things he posted re: sarah Mersinger's and their solid bond? I screen capped it and pages from her fb.
Im not buying his story but I cannot come up with a theory that makes sense unless his gf is sick and demanded proof of his loyalty, like a wicked attraction scenario. Poor flow of details. However, though the information sucks, the police cracked this case like a walnut and I admire the way they handled it.
