Amanda Knox: Italian Court Rules Against Knox


Italy ruled that Amanda Knox' acquittal was in error, and that she participated in a sexual homicide; exactly what Statement Analysis has found.

Knox has cashed in on her fame with her multi-million dollar book deal with no one betting she'll spend a day on Italian soil.

The family of her victim remains bereft of both daughter and justice while one of the participants has made a life time's fortune off of their pain.

Italy's high court today faulted the acquittal of Amanda Knox by the appeals court for the murder of her roommate, ruling that it WAS a 'sex game gone wrong' and ordered her back for trial.

The Supreme Court said the ruling was full of 'deficiencies, contradictions and illogical' conclusions and ordered the new appeals court to look at all the evidence to determine whether Knox helped kill the teen.

In March, the Court of Cassation overturned Knox's acquittal in the 2007 murder of flatmate Meredith Kercher and ordered a new trial.

On Tuesday, the high court issued its written reasoning for doing so. Kercher's body was found in November 2007 in her bedroom of the house she shared with Knox in Perugia, a central Italian town popular with foreign exchange students.

Knox, now 25, and her Italian ex-boyfriend, Raffaele Sollecito, 29, were initially convicted and sentenced to long prison terms, but a Perugia appeals court acquitted them in 2011, criticizing virtually the entire case mounted by prosecutors.

The appellate court noted that the murder weapon was never found, said that DNA tests were faulty and that prosecutors provided no murder motive.

A young man from Ivory Coast, Rudy Guede, was convicted of the slaying in a separate proceeding and is serving a 16-year sentence.

In the 74-page Cassation ruling, the high court judges said they 'had to recognize that he (Guede) was not the sole author' of the crime, Italian news agency LaPresse reported. The judges though said he was the 'main protagonist'.
They said the new appeal process would serve to 'not only demonstrate the presence of the two suspects in the place of the crime, but to possibly outline the subjective position of Guede's accomplices'.

It said hypotheses ran from a simple case of forced sex involving Kercher 'to a group erotic game that blew up and got out of control'.
The high court faulted the Perugia appeals court for 'multiple instances of deficiencies, contradictions and illogical' conclusions.

The new court must conduct a full examination of evidence to resolve the ambiguities, it said.

Knox left Italy a free woman after her 2011 acquittal, after serving nearly four years of a 26-year prison sentence.

Now a University of Washington student in Seattle, she has called the reversal by the Cassation 'painful' but said she was confident she would be exonerated.

Italian law cannot compel Knox to return for the new trial and her lawyers have said she has no plans to do so. It is unclear what would happen to Knox if a possible conviction from the new trial is upheld on final appeal.

No date for the new trial has been set. Florence's appeals court was chosen since Perugia only has one appellate court.

Knox and Sollecito denied wrongdoing and said they weren't even in the apartment that night, although they acknowledged they had smoked marijuana and their memories were clouded.

Last month Knox said the future was very unsure for her financially and that she is almost broke because of her huge legal bills - despite a $1.5million book advance.

To LE it's a rape case that involves three willing participants and one girl who was forced to participate.

The three willing participants survived the group sex and the girl who was forced into sex died.

A simple case of rape and murder because one person resisted the force of three people bent on violating her body.

I hate these types of crimes because they are actually gang rapes where the victim has to die in order to shut her up permanently.

Even though there is going to be a new trial, I thought that they couldn't extradite her.
Will the trial go on without her there and if she is convicted will she be forced to go there for incarceration?

I went over a lot of the records in the PerugiaMurderFile site a few years ago and I was convinced of her involvement. I know people whose only understanding of the case comes from the US Media and the spin from her parents PR campaign - and of course, they're convinced she is just an innocent college student. If everyone read the same information we'd probably have a better chance of coming to the same conclusions but some have read one thing and others have read or heard another. It's sickening to see the "foxy-knoxy" spin too. It seems like the cases where the female can be seen as attractive are the ones that get more attention. Maybe there is a lot more to it but it certainly seems like a factor. Why should it matter what she looks like? I suppose it's just the discord between what appears to be sweet innocence and the facts of the crime.

Amanda Knox's blood was found in the bathroom, mixed with Meredith Kircher's blood

Amanda stated her blood could not have been found in the bathroom prior to the murder because she cleaned the bathroom regularly.

That means the blood smear containing both Amanda and Kircher's blood HAD to have been smeared in the bathroom the night of the murder since Amanda INSISTED the bathroom was cleaned and blood free BEFORE the murder.

AMANDA KNOX stated Meredith Kircher NEVER visited Raffaele Sollecito's kitchen or apartment yet Sollecito stated Meredith accidentially knicked herself with the knife, ADMITTING 1) the knife was his and 2) Meredith visited his apartment and MOST IMPORTANTLY 3) the blood on the knife was Meredith's and he'd witnessed her blood getting on his knife.

GUILTY, put them BOTH back in prison, for LIFE!

AK lived there. I read that AK's blood was found mixed with MK's blood. It is possible that MK's blood was found mixed with AK's blood. As in AK's blood could have there prior and MK's blood later introduced by whatever means later occurred.

Amanda's not going back, no way, no how. She'll use that book money to disappear if necessary.
I remember when she first got home, she made the statement that she would still go back it Italy. I didn't believe it then, I don't believe it now.
Amanda served 4 yrs for her involvement, whatever role she played, in a murder. No way in H--- she's going back.
She got off easy.

It is doubtful that Amanda Knox will return to Italy to face another trial.

She has a book deal and she would not want to miss her chance to peddle her story.

Besides, those Italian officials are convinced that she is guilty and want to lock her up again.

So why risk it?

I don't know if any of you watched the interview with Diane Sawyer but there was a point where Diane asked her point blank - did you kill meredith. Everyone here should look it up on youtube - it was priceless. She's guilty as sin and looked proud that she had gotten away with it. The smirk on her face and the nodding yes while saying she didn't have anything to do with it was telling. I saw and heard all I needed to know after that and turned it off. The Italians need to retry her and get her butt back in prison for the rest of her life.

I am so glad the Supreme Court's ruling has finally come out ! Remember: the Supreme Court had already ruled in Guede's case that he did NOT act alone, that Knox and Sollecito participated in the murder.

Interesting update: Knox's ex-boyfriend, Rafaelle Sollecito, can NO longer stay in Switzerland -- apparently, he did not disclose information about his pending legal proceedings so the Swiss "sent him packing."

Another update: Knox's book is an epic fail ! Sales are much lower than the FOA expected, and her book is already being discounted at 40% in bookstores.

The US media needs to stop treating Knox as the "victim" -- she is a murderer AND Knox is also a "convicted felon" for naming an innocent man as Meredith's murder, which is a CRIME in Italy.

There is only ONE victim: Meredith Kercher!

The case is far from black and white. Rudy Guede, a native of the Ivory Coast, was convicted for his role in Kercher’s murder in October 2008 in a fast-track trial that lasted just one month. Even though he was tried alone, he was convicted as one of a group of assailants, and was never considered by any court to have acted as a lone wolf. His conviction was upheld by Italy’s highest court, but his sentence was reduced from 29 to 16 years. He is eligible for work release and furloughs in late 2013.

Rudy Guede confessed. His DNA was found on/in the victim's body. His confession included only himself. He is the sole perpetrator.

Amanda Knox and her former boyfriend Raffaele Sollecito hugged and kissed during a secret reunion in New York this week, it has emerged.

The former lovers were pictured strolling in New York on Tuesday - just hours after Italian judges ordered them to return to court for a retrial for the murder of British student Meredith Kercher

The tryst has already led to concerns that the couple should not be in contact with each other now they have been recalled for a re-trial.

As reported by the Daily Mirror, the pair were pictured hugging closely, with Knox closing her eyes during the warm embrace as Sollecito kissed her cheek. The meeting has led to rumours that the pair have become romantically involved again. James Terrano, who is reportedly Knox's boyfriend, was nowhere to be seen.

As the pair walked and chatted along a street in New York, Knox's mother walked behind.

One onlooker, speaking to the Daily Mirror, said the pair looked like a couple who had been together for sometime.
He said: 'You only have to look at him to see he still holds a huge torch for Amanda.

'They never once stopped chatting. It's astonishing they are allowed to even talk to each other, let along see one another, considering they are both suspects in a murder trial.'
Knox declined to comment on the reunion, with Sollecito admitting the pair have much to plan.

Hours before their secret reunion on Tuesday, Italy's high court faulted the acquittal of Knox and Sollecito by the appeals court for the murder of Miss Kercher.

The court ruled that the 21-year-old's death was a 'sex game gone wrong' and ordered the couple back for trial.

This has resulted in Sollecito launching a desperate $500,000 online appeal for donations to fund his retrial.

The computer studies graduate said he was hard up and needed the cash for 'legal expenses' but added anything raised above the target he would 'donate to a research foundation'.

In an appeal posted on his Facebook page Sollecito wrote: 'Well Guys, the problem for me now is pretty though.

'I'm deeply concerned not just for the issue I'm facing and most of you already know about, but also because I don't have resources anymore to fight this injustice.

'I badly need to be able to hire experts, when needed, or pay my attorney fees, documents fees, and so on when the new appeal will start.

'I hope to not bother you, but I need your collaboration to face this ordeal. Otherwise I don't want to forced to give up just for financial reason.

'I hope you will understand. I'm just asking if you, buddies, know how to build up a non-profit raising funds foundation. Big Hugs, Raffaele Sollecito.'

Sollecito is thought to have been paid $1 million for American TV news interviews and an advance on his book Honour Bound My Journey to Hell and Back with Amanda Knox, which was published last year.
However a sizeable proportion of that was swallowed up in legal fees to his team of lawyers including Italy's high flying Giulia Bongiorno who is said to have the highest fees in the country.

On his Facebook page he invites potential donors to help him out via a page called Gofundme.com and on it he adds: 'This new Trial will take other 6 or 7 years more with witnesses, transfers, documents, experts and everything will be discussed all over again.

'We are both very grateful for the high attention that has been paid to this case by his lawyers Giulia Bongiorno and Luca Maori.'
As of early today, 31 people had donated with the largest amount being $1,000 from an anonymous donor and the total standing at more than $4,000 - at that pace he will have made his target by the time the trial starts.

The site was also subject to fierce criticism with several people posting comments expressing their outrage one woman Silvia Pavan wrote in Italian: 'Why don't you ask Amanda Knox for money ? Or better still why don't you kill yourself ??? Murderer.'

Another called Lucia Rossi said: 'Scandalous. A killer asking for money...where have we ended up.'

Miss Kercher was found semi naked and with her throat cut in the bedroom of the house she shared in the Italian hilltop town of Perugia with his American former girlfriend.

He was given a 25 year jail term while Knox was given 26 years but in 2011 the verdicts were overturned and they were released on appeal.

However, three months ago Italy's highest court ruled there should be a fresh trial for both of them.

That is an interesting theory -- and that would work in the US because of "spousal privilege" -- but Italy, now that may be a different story. Don't know if Italy has "spousal privilege" but taking a "wild guess," I would guess not.

Sollecito tried to settle down in Switzerland but he got the boot ...

I have no doubt that Knox and loverboy are communicating some sort of way -- they can't trust each other and are not sure IF one or the other will throw the other under the bus ...

It's going to get very interesting when the extridition gets going ...

In his first appeal he "confessed" he WITNESSED AMANDA KNOX MURDERING MEREDITH

He said that, emerging from the bathroom, he had found a shadowy figure, holding a knife, standing over Kercher, who lay bleeding on the floor. Guede said that he and the man struggled.[211] Guede was cut on the hand, and fell to the floor, but picked up a chair.[213] He described the man as an Italian with light-brown hair, without glasses,[212] and shorter than him. The man fled while saying in perfect Italian, "Trovato negro, trovato colpevole; andiamo" ("Found black, found guilty; let's go").[214]

The United States expects other countries to extradite people we want here, so the U.S. is obligated to hand over people wanted by those countries with which we have an extradition agreement. It doesn't matter if we have double jeopardy - she was found guilty there and needs to go back.

Raffael walked into the aftermath, the clean-up stage, Meredith blackmailed him into complicity: I used your knife and everybody will tell police you tried to get in her pants: police will believe you killed her in a rage after seeing her have sex with Guede

Trigger, you nailed it. I also hate the label. There's nothing simple, standard, ordinary, typical, every day, generic, uncomplicated, etc., about a heinous murder carried out during a sexual sadism/gang rape.
