Hearing for lawsuit seeking release of Ramsey indictment set for Oct. 11
A hearing for a lawsuit filed by a Daily Camera reporter and a press advocacy group seeking the release of the indictment secretly voted on by the JonBenet Ramsey grand jury in 1999 has been set for 1:30 p.m. Oct. 11.
Camera reporter Charlie Brennan and the Reporters Committee for Freedom of the Press filed the lawsuit in Boulder District Court, citing the Colorado Criminal Justice Records Act in an effort to compel Boulder District Attorney Stan Garnett to release the indictment.
The Camera reported earlier this year that the grand jury voted to indict the slain 6-year-old's parents on charges of child abuse resulting in death, but that then-District Attorney Alex Hunter refused to sign the document and prosecute the Ramseys.
The Camera is not a plaintiff in the complaint, but does support the lawsuit.
Retired Weld County Judge Robert Lowenbach will preside over the hearing after Boulder District Judge Andrew Hartman recused himself from the case.
The Boulder DA's Office has not yet filed a written response to the lawsuit, but Garnett said one would be filed within the next few days.
Garnett previously has rejected two requests by the Camera and Brennan seeking the release of the indictment under the Colorado Open Records Act.
In 2010, Brennan worked for Garnett as communications director on Garnett's campaign for Colorado attorney general.
Six-year-old JonBenet was found dead Dec. 26, 1996 in the basement of her family's home, 755 15th St., several hours after Patsy Ramsey called 911 to say her daughter was missing and there was a ransom note.
In October 1999, more than a year after the case went to a grand jury, then-D.A. Hunter announced that the grand jury investigation had come to an end and that no charges would be filed due to a lack of evidence.
But in January of this year, Brennan reported in the Camera that members of the grand jury confirmed they voted to indict both John and Patsy Ramsey on charges of child abuse resulting in death and that Hunter refused to sign the indictment, believing he could not prove the case beyond a reasonable doubt.

It being 2013 and fourteen years since the convening of this grand jury, it would be interesting to see what evidence they thought they had back in 1999, three (+-) years after JonBenet was murdered.
Could it be that Alex Hunter was right not to prosecute the Ramseys at that time?
Nonetheless, the final decision concerning prosecution should not be left up to one person, the all powerful (and possibly corrupt) prosecutor. Once the jury has spoken, THIS should be the final decision whether to prosecute someone and the prosecutor should be duty bound by law to follow their instructions.

Max Clifford protested his innocence as he arrived at court to enter pleas on charges of indecent assault on teenage girls and women.

I and many other suspected something was up epspecially when gerry turned up in PDL presumably to talk to his attorney.
We also know that the mccann libel case is proving catastrophic for the mccanns with their own witness doing much to support Goncalo Amaral (clearly they haven't learned the script) Isabel duerte is losing her temepr resorting to lots of shouting, it didn't help her case when she admitted her friends said she was defending a mother and father who killed their daughter ( damn that missing allegedly thus making it a statement of fact) we are still unable to confirm if gerry amd kate have split though we do now know gerry's siste is now divorced. it is telling they are not appearing in court togeather.
Regarding the crimewatch reconstruction, until we see it we don't know what is in it , will they go with the alleged timelines which are impossible or will they go with something else. I hope you are right MJ, because this same flaw in the system is what allowed the all-powerful prosecutor, Ray Gricar, to decide there wasn't enough evidence to prosecute Jerry Sandusky in about 1998 for child abuse allegations that had been made prior to that time, which the grand jury in that case too recommended that Sandusky be prosecuted.
If he had been it would have saved many more boys from Jerrys' evil hands and violent abuse, plus those he had already been abusing and continued to abuse for the next twelve years. There again, ONE MAN alone made the decision to allow an evil pedophile to continue to destroy many lives. THIS is a terrible injustice to the innocent.

LUDINGTON, Mich. (AP) — A western Michigan man has been charged with killing his infant daughter, who disappeared more than two years ago, prosecutors said Friday.
The filing of an open murder count against Sean Phillips "moves us one step closer to securing justice for Baby Kate," state Attorney General Bill Schuette said when announcing the charge with Mason County Prosecutor Paul Spaniola.
Phillips, 23, was convicted last year of unlawful imprisonment in the disappearance of Katherine Phillips. She was 4½ months old when last seen in the Ludington area, about 80 miles northwest of Grand Rapids.
Schuette said at a news conference that "new evidence has been discovered which supports a murder charge in this case," but provided no details, the Ludington Daily News reported.
Phillips was arraigned Friday during a videoconference with Magistrate Patricia Baker, who said she would appoint an attorney to represent him.
Prosecutors said previously that Phillips took the baby from her mother because he feared a court-ordered paternity test would show he was the father. He received a sentence of 10 to 15 years in prison and is appealing.
Katherine's mother, Ariel Courtland, testified earlier in the case that she last saw her daughter in a car seat in the back seat of Phillips' car.
The Daily News reported that police found Phillips about three hours after Courtland reported her daughter's disappearance. Officers found the baby's car seat and diaper bag in the trunk and found her balled-up, inside-out clothing in his pocket, the newspaper said.
Investigators have said that seeds and other material on Phillips' shoes could be crucial to locating a body.
Spaniola said that since Phillips' conviction on the related charge, detectives have spent "countless hours" on the case.
"This continuing investigation has included review of biological evidence, site visits, and the enlistment of experts from all over the world who are preeminent in their fields," Spaniola said.
Ludington city police and the Mason County Sheriff's Department worked on the case with help from the Michigan State Police and the FBI.
The open murder charge means a jury can consider both first- and second-degree murder.

A Dallas County jury Thursday convicted a 19-year-old man of capital murder in the beating death of his girlfriend’s toddler.
State District Judge Robert Burns sentenced Alex Roberson to an automatic sentence of life without parole in the murder of 20-month of Trey Jenkins.
The injuries that killed Trey indicated he suffered a brutal beating in July 2012.
Twenty-month-old Trey Jenkins feeds his baby sister. He was beaten to death in July 2012 by his mother's boyfriend.
The boy was so badly beaten from behind that his kidneys moved to the front of his body and he suffered 13 broken ribs. His liver was lacerated, his adrenal glands were destroyed and his lungs collapsed, according to testimony.
Trey’s mother was at the store when paramedics were called to their Love Field-area home. Roberson told police that the boy became lifeless and got a bloody nose during a diaper change.
Roberson changed his story about what happened during two interviews. One interview was recorded on audiotape. The second was captured on video.
A mistrial was declared in a previous trial in June when jurors could not reach a unanimous verdict. Jurors at that trial voted to 10-2 in favor of guilt.

LUDINGTON, Mich. (WOOD) - Baby Kate's mother said she is surprised at the speed of a murder charge against Kate's father.
Michigan Attorney General Bill Schuette said Friday that his office would work with the Mason County Prosecutor's Office to try and convict Sean Phillips of the murder of his four-month-old daughter Katherine.
"Justice delayed is not justice denied," Schuette said at a Friday press conference during which the murder charge was announced.
Katherine Phillips disappeared June 29, 2011 and is presumed dead. She became known as "Baby Kate" in the nationally covered investigation. Phillips was convicted last year of unlawful imprisonment in her disappearance.
Kate's mother Ariel Courtland said news of the murder charge took her by surprise because she didn't learn of it through investigators, who she said have been supportive throughout the ordeal.
"For me to find out through the news that this was happening was kind of a slap in the face," she said.
For some, murder charges were welcome. But the announcement means something else to Courtland.
"I'm just disappointed that we have to do it so soon already," she said.
She must now explain the situation to her other daughter, who also belongs to Phillips.
"She has to come home and ask why," she said. "It's hard for her."
With one conviction in hand and a long prison term imposed, Courtland said she hoped this day would come further down the road.
Part of her struggle is realizing the other people this case has impacted as her once tumultuous relationship with Phillips' parents has turned into a bond.
"It's not just me. His parents grieve like we do. This is still their son," Courtland said. "They love Sean so much and it's hard to see their heart break just like mine."

WRONG, and for future safety it should be known the reason baby seats should not be in the front seat is because the belt attaches further forward which leaves the baby seat able to be twisted out from the belt. and not all baby seats have the holes to wind the belt through and 99% of women dont take the time or effort to do that, they just whip the belt over the top. and if the baby seat is place facing forward instead of the baby facing backwards, it is even more dangerous.
i did exactly what he described with a top dollar baby seat when i tested it for being secured correctly before i ever used it. we never put a baby seat in the front, and the one that was permanently in the back i used the extra tie down strap that runs back into the trunk.
put a baby seat facing forward in the front seat. strap it in like your baby was in it, now, grab the top and slam it against the dashboard.... yep, your baby just died dumbass.
The process as it presently stands doesn't appear democratic. A (grand) jury of peers decide that the time and cost to proceed is warranted, the police believe so otherwise he/she wouldn't have been arrested and a case built against them presented. Why does the prosecutor for the state get to veto all? He should just be rubber stamping it to proceed. It shouldn't be about *his* ego and whether it will affect his track record of wins vs. losses.

He didn't know, it was an accident, he did not know that Mom had not gotten her out of the car due to him trying to ignore her and not paying attention to what she was doing, when Mom shut the car door he thought Kate was out, and he drove away and never looked back.
Mom must have unlatched the seat belt and got the babyseat ready to remove but didn't. It must have then fallen down onto the floor board between the front and back seats in order for it to be wedged/caught and for the front seat to not slide back.

So was it Kate being thrown from the car seat that killed her, or was it from hitting her head as the babyseat fell to the floor, or was her head crushed when he tried to force the front seat to move back?
imo, Kate died of blunt force trauma to the head. He too wanted to "fall" causing his head to explode like Kate's did.

imo, LE blew it. They should have allowed him to talk to her. Now he has come to terms in his mind and no longer needs to talk to her. He was even willing to show LE where Kate was, but LE did not cooperate. In his mind, it is now LE's fault that she will never be found.
He "set" her there. Where is the baby car seat? He didn't lay her there, he set her there, she is in the sitting position.

So gerry, who was putting them to bed if it wasn't you and kate?
If it had been either of you then the question would never have arisen as you would have been there.

If you and kate were in apt 5a where were the children being put to bed and again by whom?
Wherever everyone was clearly you were not with the children as you would have heard them

Such a shame that a Grand Jury decision is not upheld. Alex Hunter should Not have had authority to overrule - much like a judge accepts the verdict of a jury.
WOWZER! This is WAY too much power for any prosecutor to have at his disposal! In this case (and the Jerry Sandusky case in about 1998 when prosecutor Ray Gricar ALSO refused to indict Sandusky per the Grand Jurys' recommendation); why bother to have Grand Juries convene to begin with?
Just ask the prosecutor to wield his mighty wand.
Here's that pesky number three again. If there were no discernible lies or any other circumstantial evidence against the McCanns, they left at least three tell-tell signs of their guilt behind themselves:
1) The curtains at the window in the room where Maddy slept were found to have been laundered, rehung, and were air drying in the open window.
2) Human decomp odor was found in the carpeting behind the couch. This means Maddy or her bodily floods laid there for up to 90 mins after she was killed.
3) Human decomp odor was found in the wheel well of the rental car the McCanns were driving a month later, which again, means that Maddy laid there deceased for at least up to 90 mins before she was removed and disposed of.
Common sense dictates that someone in that room who had access to that car killed and disposed of Maddie.
