Sensitivity in Allegations: Sexual Harassment Claim


New analysts initially struggle with sensitivity indicators found within allegations or accusatory questions. 

Human Resource professionals deal with many aspects of an investigation, including knowing that allegations could produce criminal and civil consequences, as well as impact the bottom line and reputation of their company.  They must get to the truth and they prosper in Statement Analysis Training.   

It helps to take a step back and trust in the principles of analysis to guide us. 

 Allegation:  Sexual Harassment 

It has become increasingly difficult to discern what constitutes "sexual harassment" in the workplace today.  One interesting trend has been predictable:  projection and virtue signaling. 

Those who "see" misogyny everywhere are being undraped and seen as actual sexual predators at worse, and sexual harassing perpetrators at best.   This is the same theme as those who see "racism" in any and every one who disagrees with them.  If you listen carefully, you will find the virtue signaling subject to be very likely a racist (or misogynist)  himself or herself.  

Misogyny in the criminal world is frightening.  This deep hatred of women was recently seen in the language and action of a same-sex adoption man who killed the little girl entrusted to his care.  His denigration of her was chilling and her death violent.  As politicians continue to reduce the definition of misogyny via false accusations, its understanding is lost.  

Sexual Harassment 

Workers routinely talk about sex, email about sex, text about sex, and so on, because they think about sex.  Some studies indicate that men think about sex several times per hour, while women think about sex once per day.  The brain chemistry is very different (physiological), beginning from near gestation and is very strong before cultural impact begins.  If male-female brains were the same in this area, our world would look very different, if it had not overpopulated itself to death.  In studies with different numbers ("males think of sex x times per minute" etc), but the consistency is found in the difference.  The MRI of the amygdala shows a 
deadening affect in female orgasm (where fear/anxiety is processed) which takes more time.  

This (and the many other differences) is found in the language differences between men and women and critical to analysis, particularly in profiling and Anonymous Author Identification. 

 The complementary nature of the two sexes is necessary for the species to survive and prosper (procreate), though the differences have now become subject to politicians's exploitation. 

Months ago, when Bill O'Reilly was accused of sexual harassment, his denial was deemed not only "unreliable" but in my conclusion:  he went well beyond inappropriate or unwelcome sexual banter and was deceptive.  He was not a victim, even if he was targeted by political enemies.  If O'Reilly is a victim, it is of his own doing.  We now learn that he paid out millions to keep victims silent.  This is not the action of innocence, nor is it as a result of inappropriate jokes.  His subsequent denials indicate deception and likely a history of inappropriate behavior that may have had further consequences.  He did not lose his job because he said, "hot chocolate mama" to a co-worker.  We seek to measure the intensity of the sensitivity but also the context of the sensitivity.  This week he said in response to the revelation of millions of dollars in payment: 

“It’s politically and financially motivated. I’m not going to sit here in a courtroom for a year and a half and let my kids get beaten up every single day of their lives by a tabloid press that would sit there, and you know it.”

These statements may be true, but when viewing his numerous denials, he goes beyond "not reliable" and his "unreliable", when measured in volume, led to my conclusion.  Regardless of the motive of accusers, his language and behavior was his own.  My  conclusion  includes viewing more specific allegations within more specific time frames by him. He has been consistently unreliable in each interview I've seen or heard.  American Thinker did a thoughtful article on him with the hope that he was taking a strong personal introspection and inventory of his behavior.  His statements do not reflect this.  

Consider "sexual harassment" the clearly communicated unwanted continuance of sexual discussion and/or sexualized behavior.  When it reaches the point of exploitation, the crime is evident: sex for promotion, sex as reward, sex as punishment, etc.  For our purpose, sexual harassment is not two workers joking, texting, emailing, when suddenly one wishes to file a claim.  Sexual harassment is the use of sex to harass, bully, intimidate, etc.  This excludes banter, discussion or mutual use of humor or flirting.  

Investigators, including HR professionals and Sex Crimes Units, must have very specific training to go well beyond "he said; she said" analysis.  Here is an example of the training. 

Case Sample 

A woman accused her supervisor of pulling down his pants during a meeting where several other employees were present to mock her. 

This is a very straight forward accusation.  It is not open to interpretation.  He either did it or he did not.   

His response: 

"Are you kidding me?  Is this a joke?"

This is a point of great sensitivity:  he heard, for the first time, the accusation, and he answered the question of the accusation (imperative) with not only a question, but two questions.  It is, therefore, very sensitive to him.

Please note:  absurdity can produce sensitivity, just as guilt can.  

The answering a question with a question indicates that the subject has to pause to consider his answer. 

This means it is sensitive. 

"Are you kidding me?  Is this a joke?"

He was then told that it was not a joke but an accusation that Human Resources was taking very seriously and may need to call in law enforcement. 

The analyst must listen. 

"This is ridiculous!"

HR Interviewer:  Is it?

Subject:  "Yes it is ridiculous.  She's nuts."

He has now still avoided a denial and now denigrates his accuser.  The level of sensitivity is even higher.

Subject:  "You realize that there were others in the room, right?"

HR:   "Hmm hmm."

Subject:  "Well?  Did you talk to them?"

HR:  "I wanted to hear it from you first."

Subject:  "What do you want me to say?  This is absurd."

HR:  "She made a formal complaint and stated that you pulled down your pants in the meeting, mocking her."

Subject:  "I did not.  Why don't you talk to the others?"

HR:  "We will.  I want to hear from you."

Subject:  (silence)  hands over head, hunched over. 

HR:  "You have the accusation.  How do you speak to it?

Subject:  "I did not pull my pants down.  I didn't even talk to her.  She's got a real wild temper so I avoid saying much to her and never meet alone with her.  She's got issues, man, and I've always been afraid of her.  You know, this is, hey, you realize, wait, where did she claim this happened?"

HR:  In the conference room.

Subject:  Yeah, it's video security camera there."

HR:  "Okay, so you said you did not pull your pants down.  Give me one reason why I should believe you."

Subject:  "Go check the video.  I'm telling you the truth, but talk to the others, go to the video.  This is ridiculous."

He finally made a denial.  The interviewer understood the nature of his avoidance, intuitively, and kept at it until the subject.  

What do we do with all that he added to this denial?  

The sensitivity indicators are one theme: he is shocked by the allegation.  As it dawned on him, anger entered his statement.  

The accusation was so bizarre that it produced a very sensitive but singular, reaction to him, initially:    shock.  Sensitivity does not make us rush to conclude deception.  This then led to anger.  

In the above, he was truthful.  The other witnesses reacted in a similar way, and the video, though grainy, showed that at no time did he stand up or be outside the view of the camera.  One expert said she was aware of her co worker's mental health but was afraid to speak out.  She said, "I knew that something like this would happen but I did not think she would make such a bold crazy allegation." 

The accuser had untreated mental health issues and her language showed childhood sexual abuse.  In her statement, the analyst was able to show perseveration.  This is part of advanced analysis where the analyst told HR that someone did, in fact, pull down his pants to insult her, but it was not her supervisor.  It happened many years ago and this is likely to come out should the company enlist a skilled therapist.  

The trained analyst must consider the sensitivity indicators within a statement and stay within his presupposition, and classify and categorize the indicators appropriately.  

For Sex Crimes Units, the ability to discern perseveration (where one repeats an accusation from history as if it is happening now) is indispensable. 

Learning the language of sex abuse victims, including disassociation within the language, is an investment in justice.  

For Sex Crimes Units, we offer Statement Analysis training with specific emphasis on the language of sexual abuse, but we also hold Advanced Seminars for those who have already reached a level of expertise in sex crimes.  The Advanced Seminar is for trained professionals and is two days of intensive work, with 12 months of follow up support.  It is complicated but it provides justice for both victims and for those falsely accused.  It is also for social workers, district attorneys and others interested in protecting a vulnerable population including adults with developmental disabilities.  Legally sound interviewing based upon the principles of statement analysis enhances those with solid social worker institute  training, Reid technique, and other schools where the discernment is necessary.

If in her subjective dictionary"sleep" means having sex, which she would have to clarify then we have two back to back reliable denials. Its not to say it didnt happen, but in the principle it is likely true that it did.not occur. If she follwed up if asked, why should i believe you, and she replied, because i told the truth, its 99% true

In context, It appears that way but it is not so. The analyst must mark this as "sensitive" and NTP. In this case, it is evidentiary, not linguistic.

The reason for this correction is that if the principle of strengthening a denial is used, it will falter in other contexts.

For one person it could mean they had sex.
To another person it means they didn't have sex, they simply slept.

This is something i often point out when the phrase pops up in conversation.

7:30 p.m.

The father of a missing 3-year-old North Texas girl is back in police custody after he voluntarily submitted to questioning in his daughter's disappearance.

A Richardson police spokesman says Wesley Matthews was charged Monday afternoon with first-degree felony injury to a child, a crime punishable by up to life imprisonment. Sgt. Kevin Perlich (PUR'-lihk) said bond has been set at $1 million for Matthews.

Perlich said the 37-year-old adoptive father of Sherin Matthews submitted to questioning voluntarily, but the particulars of his answers that might have led to the charge have not yet been explained. However, Perlich said Wesley Matthews gave different answers to police questions than before.

Previously, the father had told police he ordered the girl to stand outside the family home at about 3 a.m. on Oct. 7 as punishment for not drinking her milk. Investigators are awaiting confirmation that the body of a young child found Sunday morning in a culvert about a half-mile from the home is that of the missing girl.

The sister of a missing 3-year-old Texas girl will remain in foster care for at least three more weeks.

A Dallas County judge postponed a Monday custody hearing until Nov. 13 for the 4-year-old sister of Sherin Mathews to allow their father, Wesley Mathews, to hire an attorney.

Police said Monday that they believe the body of a young child found about a half-mile from the family's home in the Dallas suburb of Richardson is Sherin's. They are still awaiting confirmation and the cause of death.

Wesley Mathews told police he ordered Sherin to stand outside of their home at around 3 a.m. on Oct. 7 as punishment for not drinking her milk. He says when he went to check on her about 15 minutes later, she was gone. He is charged with child endangerment and is out on bond.

Police have said that Mathews and his wife adopted Sherin from India. The 4-year-old is their biological daughter.

Why would an innocent person pay a monetary settlement to someone who has accused them of a crime they did not commit, especially a sexual crime?

If you didn't do it then you would demand your day in court to prove your innocence and then when found not guilty, if you haven't already, Sue the other person for making an attempt to obtain money by deception, fraud, slander, libel, blackmail, extortion and anything else you can think of as well as demanding the police prosecute them for filing a false police report, wasting police time and anything they can think of.

Innocent people want their day in court.
Guilty people want to stay out of court even if it means buying their victim off.

Can you name some who are innocent of the crime they were accused of, proven so and who paid their alleged victim compensation for a crime they did not commit?

In Bill's case, we have millions, untold, lots of deception and a refusal to deny. This one isn't even close or difficult to discern.

He's likely not a Weinstein, but he is not truthful, either.

In the progressive corporate environment I work in, the banter, humor, or flirting can easily put a man's job at risk.

Termination would be doubleplus quick if the evidence is in an email or text.

Any banter is restricted to traffic or the weather.

I would have thought OReilly would have been to smart to repeat the same behavior after being accused and paying dearly for it. Why would you not refuse to meet or work in a room with women with no witnesses or video. why not have Fox hire a personal assistant just for that reason.
I can say for me, and I'm poor, that I don't think I would settle when I know I'm innocent. But, if I was rich or somebody else was paying, I might would. BUT, I would go forward knowing there was a target on me, and would try to be secure the next time someone accused.
Republicans and conservatives have to know the other side is willing to stoop to any low to bring them down.
And no, I not even going to bring up could/would that happen in reverse.

Legal battles are expensive and time-consuming. Reaching a settlement is simpler, and protects from public scrutiny.
Even in a court trial, a defendant has the right to avoid testifying - and choosing to not do so is Not supposed to weigh on the judgement of guilt or innocence.
Avoiding public comment either way, should not be the Sole factor in deciding the veracity of the accusation.

A 29-year-old former Eastern Michigan University student was arraigned Monday on charges that he placed racist graffiti around the Ypsilanti campus on three separate occasions.

Eddie Curlin, who was an EMU student from 2014 to early 2016, has been charged with three counts of malicious destruction of property, four counts of identity theft and one count of using computers to commit a crime.

The first incident took place in September 2016 when the letters 'KKK' - seemingly referencing the Ku Klux Klan - and underneath in bold black 'leave n*****s was spray-painted on an exterior wall, reported the Eastern Echo. The letters 'KKK' were painted in red, white and blue.

An October 2016 incident had the message 'leave n*****s' again scrawled outside of a building, this one right next to the campus's monument to Martin Luther King.

The third incident took place last spring in which a racist message was found in a men's restroom stall in Sherzer Hall, according to EMU.

DALLAS – The father of a missing toddler whose body was found in a culvert under a road in suburban Dallas now says the girl choked to death on milk in the family's garage after earlier claiming she wandered off in the middle of the night when he sent her outside as punishment for not drinking her milk, authorities said.

Wesley Mathews reported 3-year-old Sherin Mathews missing on Oct. 7 and searchers with cadaver dogs found her body Sunday. Richardson police said Tuesday that the Dallas County medical examiner's office used dental records to identify the body as that of the child.

Police said the medical examiner has not yet determined a cause of death, and an autopsy hasn't been released.

Mathews, who adopted Sherin from India in June 2016 with his wife, Sini Mathews, was arrested Monday after he voluntarily revised his police statement on what happened to the girl. His attorney, Rafael De La Garza, did not immediately return a phone call Tuesday.

Mathews initially told police that he had sent the girl to stand outside at 3 a.m. near a tree across an alley from the family's fence because she refused to drink her milk. In his revised statement Monday, he said the girl choked on the milk and that he removed her body from the home after he believed she had died.

Richardson police spokesman Sgt. Kevin Perlich said Tuesday that the investigation is continuing, despite the revised statement.

"This by no means completes our investigation. It is possible there would be additional arrests or modifications of the charges as the investigation proceeds," he said.

Police on Monday charged Mathews with first-degree felony injury to a child, punishable by up to life in prison, and he was being held on $1 million bond. He was initially charged with abandoning or endangering a child after reporting the girl missing.

Perlich previously said police believe Sini Mathews was unaware of her husband's alleged punishment of the girl and that she was asleep at the time. She cooperated with police to identify Sherin's body, he said.

According to an arrest affidavit filed Tuesday by Richardson police, Wesley Mathews said Monday in an interview that he had been trying to get the girl to drink her milk in the garage.

"Eventually the 3-year-old girl began to drink the milk. Wesley Mathews then physically assisted the 3-year-old girl in drinking the milk," according to the affidavit.

Mathews told police that Sherin began to choke, she was coughing and that "her breathing slowed." He said he eventually felt no pulse and believed the child had died. Investigators wrote that he "then admitted to removing the body from the home."

The affidavit does not say whether Mathews told police he administered any medical aid to the child.

Perlich said Mathews previously told police that the girl had developmental disabilities and was malnourished when they adopted her from India. The couple described a special diet regimen that required her to eat whenever she was awake, in order to help her gain weight.

Mathews said that after punishing her for not drinking her milk, he went outside where he made her stand to check on her at 3:15 a.m. and discovered she was missing. Mathews said he decided at that point to do laundry while he waited for daylight to look for the girl or for her to return.

He called police and reported her missing about 8 a.m. Police had also sought surveillance camera footage from neighbors and local businesses, saying they believed one of the family's cars— a maroon Acura SUV— had left the house between 4 and 5 a.m.

State Child Protective Services removed Wesley and Sini Mathews' 4-year-old biological daughter from their home soon after Sherin was reported missing. A judge said Monday that the girl will remain in foster care until a custody hearing in November.

A spokeswoman for the state agency said family members in Fort Bend County, outside Houston, have expressed interest in taking care of the girl, but that a judge will decide where she is placed.

I know we don't have a statement from either of Sherins adoptive parents but I didn't buy his first story and I'm not buying his second one either. And I'm not too sure I believe the adoptive mother was sleeping either. I mean, neither adoptive parents made a plea for help in public when Sherins was initially reported missing (hours after the fact supposedly). The adoptive father didn't even change his story until after Sherins body was found. It's all hinky.

Almost a year after Sherri Papini was first reported missing after going for a jog near her Northern California home before being found beaten and branded on a highway Thanksgiving morning, officials released new details Wednesday on the case.

The FBI released sketches of two women Papini said abducted her on Nov. 2, 2016 while she was out for a run near her home.

The first woman was described by Papini as Hispanic, between 20 and 30 years old, about 5 feet 5 inches tall, with coarse, curly dark hair, thin eyebrows and pierced ears, FBI officials said.

The second woman was described as Hispanic, between 40 and 50 years old, about 5 feet 7 inches tall, with long, straight black hair with some gray in it. She had thick eyebrows and pierced ears, the FBI said.

"It has taken time for Sherri to recover to a point to be able to provide accurate details to the sketch artist," the Shasta County Sheriff's Office said in news release. "The sketches then needed to be finalized and approved for release by the FBI."

Papini also told investigators the women were driving a dark-colored SUV with a "large rear side window."

"Sherri continues to look at photographs of various makes and models of SUV’s in an effort to provide a more detailed description," the sheriff's office said.

n addition to the details on the suspects, the sheriff's office gave additional details on Papini's physical condition when she was found on the side of Interstate 5 on Thanksgiving, 140 miles away from her home.

"Sherri appeared battered and bruised, her hair had been cut to shoulder length and she had a brand on her right shoulder," the sheriff's office said. "Sherri, however, stated she had not been sexually assaulted, and there is no physical evidence to indicate otherwise."

The mother of two was also branded with a threatening message.

"The Sheriff’s Office continues to examine the brand and its possible meaning, but details of the brand remain confidential as part of the on-going investigation," police said.

Papini's husband, Keith reported her missing on Nov. 2 when she didn't pick up their children that afternoon from their daycare provider. Included in the release of information from police was a 911 call made by Keith, where he described the last time he heard from her and what she was wearing.

Authorities said they conducted a polygraph exam of Keith and "excluded him from involvement" in his wife's disappearance.

"Keith and Sherri Papini have remained in contact with the Sheriff’s Office and the FBI," the sheriff's office said. "Sherri, continues to provide details as she can recall them, but has not been able to provide a complete detailed statement due to her poor recollection."

Papini and her husband are believed to still live in Redding, Calif.

Days before Papini's disappearance, police said she was texting with a man in Michigan, and the two tried to meet up while he was in California. Investigators later interviewed the man, and determined he was not involved in Papini's disappearance.

Officials said they have received over 600 tips from around the world as part of their investigation, and continue to review all tips they receive.

A $10,000 reward is being offered for information leading to the identification of the two women.

Anyone with information about the Papini investigation or the two captors is urged to call the FBI at 916-746-7000.

California mom Sherri Papini was brutally kidnapped from her home, beaten and branded before being dumped on a highway nearly one year ago.

Papini, who has only now been able to describe her attackers to a forensic sketch artist, had said that her abductors were two women.

But investigators have collected male DNA from the clothing that she was wearing when she was found on Thanksgiving morning last year and female DNA that was discovered on Papini's body, the Shasta County sheriff's department has revealed.

The department also revealed that Papini's texts with a man in Detroit, Michigan have been investigated.

Officers traveled to the Michigan city on November 9 last year, back when she was still missing, the Redding Record Searchlight reported. She was allegedly kidnapped on November 2.

Police have not commented on the specifics of the Detroit investigation.

The news comes as sketches of her attackers were released.

Papini's phone was discovered a mile away at the intersection of Sunrise Drive and Old Oregon Highway – neatly placed on the ground and with the headphones tidily wrapped around it.

Keith, who said at the time that his wife would never leave him or their children voluntarily, also launched an appeal – a GoFundMe account raising cash to pay for the search.

Managed by his sister Suzanne, who now lives in Long Beach, California, the Bring Sherri Home Safe appeal eventually raised a total of $49,070 – just short of the $50,000 goal. It is not clear what has happened to the money.

Papini was eventually found 150 miles away in the 452-person town of Yolo, which is approximately 15 miles north of Sacramento, early on the morning of November 24.

According to police, she was found on a rural road just off the I-5 freeway and, despite being chained, had managed to flag down a passing car.

Her long hair had been hacked off and Sheriff Bosenko said she had also been beaten and branded by her alleged captors.

Here's a follow up on Theresa Lockhart: Her body was found via a map drawn by her stalker/killer husband upon his self inflicted death.

Hiding her car in an off interstate parking ride share is similar to the off interstate kills you so often hear about that are never solved.

Bet his neighbors are relieved he's dead and now they can have peace and not live in fear.

I don't recall there ever being any analysis on missing Lockhart. Perhaps a mere mention in the comments section as OT. It was more about what he did and did not do rather than things he said. He may have uttered a few words, but who can believe what journalists report when they are trying to make friends and win contacts that will better them.

Her employer reported her missing, not her husband. Her car was found nestled among a group of other cars that are known for going every direction under the sun.Her neighbors heard screaming and death threats in the past. The neighbors also became stalking victims of this wife killer who had a history of stalking in his younger years. He blamed the victim may have jumped out among words to be analyzed would be all I could say, though I don't actually remember.

I wanted to let whomever brought the subject to the comment section know as it would benefit them if they had any interest in knowing what became of the situation.

Thank you for the Lockhart update. It's interesting to see what the mind is capable of living with. It appears what his own hands did was too much for Chris to live with. He didn't use satan as a scapegoat. Compare Lockhart to John Skelton, whose boys are still missing. John hasn't talked and will be free again in ten years. Some who knew Amanda Blackburn are keeping secrets, even though they are using god and Satan and thugs as scapegoats (IMO), I often wonder what psychological and mental theological hula hoops they go through to sleep at night.

I am confused about the use of analysis in sexual abuse statements.

How does an analyst judge the potential for sensitivities influencing the language and yet apply the rules of analysis to the statement?

IOW, do the sensitivities trump the rules in some cases? How can the analyst tell when this is the case?

Will you be posting an analysis of the Harvey weinstein victim statement?
